January 14, 2021 The message with which Whatsapp warned its users of the updates that will be made, from February 8, in the terms of service - in particular regarding the sharing of data with other companies of the group - and the same information on the treatment that will be done with their personal data,

are unclear and intelligible

and must be carefully evaluated in light of the privacy regulations.

Thus in a note the Privacy Guarantor,

who emphasizes that he has brought the matter

to

the

attention of the Edpb, the Board that brings together the European privacy authorities.

The Guarantor - continues the note - believes that from the terms of service and from the new information it is not possible for users to

understand what

changes have been introduced

, nor to clearly understand which

data processing will actually

be carried out by the messaging service after the February 8.

Furthermore, according to the Authority, this information does not therefore appear to be suitable for allowing Whatsapp users to express a

free and aware will

.

The Guarantor therefore

reserves the right to intervene

, as a matter of urgency, to protect Italian users and to enforce the rules on the protection of personal data.

Platform in the storm

The clarifications of the platform (with over two billion users) owned by Mark Zuckerberg, reiterated in recent days also via Twitter, were not enough:

We want to address some rumors and be 100% clear we continue to protect your private messages with end-to-end encryption.

If your baker knows your data

The privacy clauses on WhatsApp

were updated on January 4th

.

As the social media expert Vincenzo Cosenza explains, the platform is about to change its Terms of Service which will still be accepted in order to continue using the application.

"Among the new clauses (see Third party information) stand out those that warn of the sharing of information with Facebook in order to

allow certain functions

", adds Cosenza.

"For example, if you chatted with the baker on WhatsApp, then the baker can use Facebook's Ads Manager to show you his new offer. Nothing outrageous if you accept the idea that WhatsApp is part of the Facebook group."
