Heilbronn (AP) - After a fatal accident in Baden-Württemberg and the alleged escape of the car driver, a court decides whether the man behind the wheel has to go to jail.

He is charged with negligent homicide and attempted murder.

On Monday (2 p.m.) it will be decisive, among other things, whether the Heilbronn district court believes the portrayal of the driver or the descriptions of the witnesses of the nightly crash.

What is certain is that the 44-year-old drove into a group from behind on a country road in the Ludwigsburg district in May 2019.

A 21-year-old crashed against a fence and died at the scene of the accident.

The other three young people suffered serious injuries.

Because of the dead man is accused of negligent homicide.

He is also on trial for attempted murder because, according to the indictment, he did not take care of the three injured at the scene of the accident in Sachsenheim.

Rather, he left her behind when he fled and only turned himself in to the police hours later.

During the trial, the man had his lawyers explain that he smoked in the car in the accident and turned his gaze from the country road to the ashtray.

He noticed a bang and assumed after the vehicle lurched that it would collide with a so-called warning beacon, which normally blocks traffic.

It was not until the next morning that he understood that the description of the accident car in an Internet article matched his car.

He then reported to the police.

The public prosecutor has applied for a total imprisonment of eight years for the accused driver.

The claim was followed by the accessory prosecution.

The defense, however, has pleaded for a suspended sentence for unauthorized removal from the scene of the accident.

The court could also convict the driver of negligent homicide and negligent bodily harm, the man's lawyer said.
