  The U.S. Court of Appeals for the First Circuit ruled to revoke the death penalty on five counts, saying that the judge in charge of the case did not adequately screen jurors to prevent potential prejudice.

  A panel of three judges said that the three convictions of Tsarnaev have been overturned. He was convicted of 30 counts. However, Tsarnaev did not have a chance to get out of the federal prison.

  "And to be clear: Since we confirmed the conviction and the many life sentences imposed on the remaining charges, Joka will continue to be imprisoned for the rest of his life for the following reasons. The only question is whether the government will end his life through execution," The opinion presented by Judge Ojetta Rogeriee Thompson of the Circuit reads.

  Three judges ordered a new trial on whether the 27-year-old Tsarnaev should be executed.

  Tsarnaev’s lawyer argued that he did not receive a fair trial. Lawyer Daniel Habib has previously stated that the jury consists of people directly affected by the terrorist conspiracy, and they cannot be tried in a fair manner. The lawyer also believes that his brother Tamirnan was the mastermind behind the attack.

  Tsarnaev is currently in a federal prison in Colorado. He was convicted in 2015, including the deaths of 3 spectators and a policeman.

  At around 3 pm on April 15, 2013, 19-year-old Joka and his 26-year-old brother Tamirnan went to the Boston Marathon to carry out their plans. Surveillance video showed that the brothers were carrying backpacks with pressure cooker bombs and traversing the crowd near the marathon finish line. Federal prosecutors called this a coordinated attack.

  The prosecutor said that Tamirnan detonated the first bomb, which was a 6-quart pressure cooker containing gunpowder and nails. The bomb killed 29-year-old restaurant manager Crystal Campbell and wounded several others, resulting in injuries to their legs. The second pressure cooker bomb they carried exploded after 12 seconds, killing two other people.

  The bombing triggered several days of raids. The Tsarnayev brothers killed MIT police officer Sean Collier while fleeing. After they stole an SUV, they were chased by the police. Tamirnan died after an exchange of fire with police in nearby Watertown. Joka was arrested a day later.
