The judge of the National Court Manuel García-Castellón has confirmed his decision and withdraw Pablo Iglesias the condition of injured in the case against José Manuel Villarejo for the leak of data from a former adviser. He does it in a car that harshly questions the performance of the Podemos leader for keeping Dilma Bousselham's mobile card for months. In addition, he points to Iglesias as responsible for the destruction of the card, which could have criminal consequences for the political leader.

Iglesias appealed the judge's decision and, as the magistrate summarizes, he maintained his condition of victim of a crime of discovery and revelation of secrets, drawing "a connection" between the commission of the removal of the mobile "for political purposes", its subsequent publication and the commissioner investigated, whom he placed as executor of the plan to harm him before public opinion.

The judge explains that at the beginning of the investigation Pablo Iglesias had the condition of injured, but as the instruction in this case has evolved and with the contribution of new data a different scenario has been revealed. First, it argues that Pablo Iglesias had in his possession the Bousselham phone card in January 2016, before the files found by Villarejo were created in April of that year.

As a second argument, the head of the Central Investigating Court 6 indicates that Iglesias concealed the possession of the memory card from Bousselham until months later. "It is inferred from the actions that Mr. Iglesias, despite being aware of the content of the card and its theft, did not return Dina the card until later, with consequences for the clarification of the facts investigated," he points out. The magistrate.

"This behavior of Mr. Iglesias is incompatible with the dimension that the appellant intends to give to the theft of the card and completely dissociates it from the sustained argument, regarding the alleged political interference," says the magistrate.

The judge considers it important to note that the appellant received the card from the president of Group Z, Antonio Asensio, and did not say anything to its owner despite knowing that it contained personal and intimate information about its owner and that, in addition, the card had been been obtained unlawfully.

Iglesias, continues the judge, was able to verify that there were captures of compromised messages from that card. For example, those who said, referring to the journalist Mariló Montero, said "I would spank her until she bled ... this is the B side of the national popular ... A somewhat perverse Marxist turned into a psychopath ..."; "You are going to see what an alpha male is when they harass someone in their group."

Iglesias "could see that these images were there," insists the judge, who closes the car considering as plausible that it was Iglesias who destroyed the card of his former adviser before returning it to him. "It is likely that this last point may be the key to understanding not only why Pablo Iglesias Turrión did not return the card to Ms. Bousselham, but most importantly, the state in which it was returned."
