The mayor of the Bavarian municipality of Bolsterlang, suspended because of a supposed proximity to so-called Reich citizens, is back in office. The Administrative Court of Munich suspended the provisional dismissal of Monika Zeller in an urgent procedure. The dismissal from the service by the Bavarian public prosecutor's office does not seem appropriate, the court ruled.

The non-party Zeller had been removed from office in June with immediate effect, because it is said to have given a number of indications of a proximity to "Reich citizens" who reject the Federal Republic as a state. Among other things, the mayor of the 1000-inhabitant community in the district of Oberallgäu should have indicated that they have the German citizenship as well as the Kingdom of Bavaria.

The administrative court decided that the allegations of the public prosecutor's office were essentially correct. Nevertheless, the court sees no sufficient evidence for the assumption that Zeller belongs to the so-called Reich citizenship movement.

Thus, the mayor in the disciplinary proceedings, at least in parts credibly asserted that it was based on information from various Internet sources, the need for proof of German citizenship. According to the public prosecutor's office, Zeller had filed petitions for the determination of German citizenship for herself and her sons. Their behavior is perhaps merely an expression of naivety and impatience, the court said.

Zeller had also acted too carelessly, as they have a "Reich Citizen" on the initiative of three former council members made a lecture in community rooms. But even this does not justify the assumption that she is "Reich Citizen".

In addition, following the presentation, she informed the local council and distanced herself from it in a town hall meeting. The public prosecutor can appeal this decision within two weeks.
