The duty of confidentiality between lawyers and prosecutors is a sacred principle of the right to defense and

legal security

For this reason, its bankruptcy by the Prosecutor's Office in an official statement in which it revealed details of its negotiations with the lawyer of Isabel Díaz Ayuso's partner has generated a very serious breach of trust with respect to the institution directed by

Álvaro García Ortiz.

The result of this rupture is the criminal and administrative complaints that the Illustrious Council of

the Madrid Bar (ICAM) announced yesterday.

It is not about defending an alleged tax fraudster, but about a basic, preliminary issue: the main organization of lawyers in Spain - with 75,000 members - does not believe that the Prosecutor's Office complies with the law.

The institutional conflict that opens is of the first order

, but it is nothing more than a reflection of the deterioration suffered by the rule of law in Spain, in which the State Attorney General plays a key role.

García Ortiz's absolute discredit in his own career now extends to the legal profession.

Last week, a newspaper revealed that the Prosecutor's Office has denounced

tax fraud and document falsification

to Alberto González, whom he accuses of presenting false invoices to avoid paying 350,000 euros in 2020 and 2021. As we revealed on our pages, the businessman had alleged that he made "a mistake" and paid 400,000 euros to repair it, before, last Tuesday, after the scandal broke out, the prosecutor in the case addressed his lawyer indicating the option of "reaching an agreement" if his client wanted.

In an attempt to refute this newspaper and highlight that González had pleaded guilty, the Madrid Prosecutor's Office then released an unprecedented press release with details of those conversations, including emails with the lawyer.

It is important to emphasize that

what is allegedly criminal is not the press publications

-protected by freedom of information and the secrecy of its sources-, but by the Prosecutor's Office in an unusual official statement.

The ICAM appreciates in this a

possible crime of infidelity in the custody of documents and disclosure of secrets

, to the detriment of the "sacred" right to defense.

With the controversy over Díaz Ayuso's boyfriend, La Moncloa has tried to divert the focus from

Koldo case

and amnesty.

Initially, the president made a mistake by defending González's innocence.

She must respond for her eventual public responsibility and not for the private responsibility of her partner, as she stressed yesterday.

Her rectification is correct.

In any case, the

verbal aggression with which his chief of staff addressed a journalist

, no matter how annoying you find the information from your media, it is unacceptable.

The task of stopping institutional deterioration is up to all of us, and especially to public officials.
