China News Service, Beijing, March 9 (Zhang Yuhui) On March 8, the "Two Highs" report was released.

In this year's Supreme People's Court work report, marriage and love issues such as domestic violence and bride price disputes have attracted attention.

"Domestic violence is not a 'family matter'. Combating domestic violence is the common responsibility of the country, society and every family."

In the work report of the Supreme People's Court, the "Mo Linhan case" that triggered widespread discussion in society was listed among them.

According to the report, Mou Linhan insulted his cohabiting girlfriend and caused her to commit suicide. He was sentenced to fixed-term imprisonment for the crime of abuse. This established the judicial rule that family members must bear criminal responsibility for violence committed by cohabitation before marriage.

The report shows that in 2023, the Supreme People's Court issued two batches of typical anti-domestic violence cases, providing judicial regulation for domestic violence against minors in the name of "love", and for snatching and hiding minor children after divorce.

It is clear that if you are in a relationship or living together and encounter violence from the other party, you can apply for a personal safety protection order. The People's Court issued 5,695 personal safety protection orders of various types, a year-on-year increase of 41.5%.

This year's National Two Sessions, the issue of domestic violence is also the focus of representatives and committee members.

Li Hui, a representative of the National People's Congress and a teacher at Beiguan Primary School in Yicheng County, Shanxi Province, said that domestic violence is not a simple "household matter", nor is it a "hidden corner" beyond the reach of the law.

The procuratorial organs support victims of domestic violence in filing divorce lawsuits or personal injury compensation lawsuits. They do not intervene in ordinary marriage and family disputes, but express a clear attitude against domestic violence by performing civil prosecutorial functions, which is conducive to guiding victims of domestic violence in a timely manner according to the law. Rights protection is also a powerful guide to the core socialist values through the rule of law.

In order to effectively prevent domestic violence, our country has introduced an anti-domestic violence law.

The newly revised Law on the Protection of Women's Rights and Interests has added a procuratorial public interest litigation clause. The procuratorial organs have explored the supervision and handling of anti-domestic violence cases and activated the anti-domestic violence governance mechanism through active performance of duties.

The Supreme People's Court's work report mentioned that in response to the increase in disputes involving betrothal gifts and even vicious cases in recent years, the Supreme People's Court issued judicial interpretations and typical cases, clearly prohibiting the solicitation of property in the name of betrothal gifts, and curbing high-value betrothal gifts in accordance with the law.

On February 1 this year, the "Regulations on Several Issues Concerning the Application of Law in the Trial of Cases involving Betrothal Disputes" issued by the Supreme People's Court officially came into effect.

The new regulations clarify how to deal with bride price disputes in situations such as extorting property through marriage and "escaping" after marriage.

Since the new regulations came into effect, many places have applied the new regulations to make judgments or mediate cases regarding bride price.

During the two sessions, representatives and committee members also provided suggestions on the issue of bride price.

Due to the emergence of stereotypes such as high-priced betrothal gifts, heavy burials and poor maintenance, the burden of expenditures on favors, banquets, betrothal gifts, etc. for the peasants during weddings and funerals has increased significantly.

Yu Li, a deputy to the National People's Congress, put forward suggestions to strengthen the daily supervision of changing customs, guide village-level organizations to conscientiously implement measures related to changing customs, and urge weddings, funerals and other institutions to standardize service behaviors and correct unhealthy practices in a timely manner.

"As a rural grassroots secretary, I deeply feel the importance of changing rural customs through legal education." Yang Hengjun, deputy to the National People's Congress and secretary of the Party Committee of Desheng Central Village, Xinqiao Town, Jingjiang City, Jiangsu Province, said about an incident he learned during a court investigation The case was a marriage and family dispute caused by a high amount of bride price.

After the case is completed, the court will discuss with the village committee, deputies to the National People's Congress, members of the CPPCC, and village representatives to write the new wedding customs into the village rules and regulations.

At the villagers' representative meeting, everyone listened to the court's suggestion and added a new article in the village rules and regulations: "New customs for weddings and funerals, accept less betrothal gifts and not be extravagant." At the same time, it was clarified that the amount of betrothal gifts should not exceed 30,000 yuan.

Yang Hengjun suggested that the court should further increase the efforts to popularize the law into rural areas, change customs through legal popularization, and promote the formation of a new trend of family civilization.
