Recently, the People's Court of Chongchuan District, Nantong City heard a case of express delivery station franchise fraud, and five defendants were sentenced to a maximum of 12 years in prison.

The Nantong Intermediate People's Court upheld the original verdict in the second instance.

  Fan, who lives in Chongchuan District, Nantong City, wanted to open an express delivery station near his home, so he searched for relevant information online.

Soon after, someone took the initiative to contact him by phone and introduced Fan to "XX Station" and said that he could join as long as he paid a deposit of 3,000 yuan and a balance of 4,000 yuan.

  After remitting the deposit, Fan received the "contract" and an old computer.

Although he had doubts, he still paid the balance, and then urged the other party to do business docking many times, but the other party always delayed on the grounds that he was queuing up for processing.

Fan called the police after realizing that he had been deceived. Based on clues, the public security organs arrested Yang and other five people in Guangzhou, Foshan, Qingyuan and other places.

  "I saw that Faxiao did a good job in recruiting investors for the post station and made money quickly, so I started to think about doing this. However, Faxiao was arrested by the police for franchise fraud not long after." The defendant Yang confessed that the cause of his crime was actually Faxiao. It was a small "lesson from the past", but instead of taking it as a warning, he thought it was a "way to make money", so he conspired with Wu to commit express delivery station franchise fraud.

  In order to fake the real thing, Yang and others contacted relevant technology companies to create a website similar to the official website of a certain express company, registered a company name similar to it, recruited many people through online channels, and established offices in Qingyuan, Guangdong, Tongbai, Henan and other places. Division.

  According to reports, their data clerks place advertisements through well-known websites, clients, etc., and use keywords such as "XX Station" to attract traffic, obtain customer information and eliminate customers from Guangdong Province.

The salesperson then recruits customers and defrauds them from investment funds in the name of joining and opening a "XX Station".

After collecting the money, the company's customer service would delay the time by making up excuses such as waiting for the "express delivery system" to be activated, and refuse to refund the customer's investment money by taking advantage of factors such as the distance between the customer and the high cost of rights protection.

If the phone communication cannot be delayed, Yang will travel to the local area to meet with some customers, and then find ways to delay it for a period of time. If customers come to defend their rights or call the police for refunds, the customer's money will be deducted for reasons such as system fees and business trip expenses.

  After investigation, from October 2021 to March 2023, Yang and others defrauded more than 800 victims across the country from investment funds totaling more than 3.9 million yuan.

  The Chongchuan Court made a first-instance judgment based on the criminal circumstances and sentencing circumstances of Yang and others, and sentenced Yang and other five defendants to prison terms ranging from 12 years to 11 months, and fined 300,000 to 300,000 yuan. Fines ranging from RMB 10,000 to RMB 10,000.

  Defendant Yang appealed against the decision. Recently, the Nantong Intermediate People's Court rejected the appeal at the second instance and upheld the original verdict.
