Analysts and experts believe that the Israeli occupation's targeting of health facilities in the Gaza Strip, and going to extremes in attacking them, is a usual policy and not an exceptional one, and violates the decisions of the International Court of Justice issued recently in the lawsuit filed by South Africa, accusing Israel of committing the crime of genocide against the people of Gaza.

In the context of what many human rights organizations described as a systematic targeting of the health sector in Gaza, and days after the Director-General of the World Health Organization expressed his deep concern about the situation in and around the Nasser Medical Complex, west of the city of Khan Yunis, the occupation forces stormed the complex and turned it into a military barracks, after demolishing its wall. The south and entered from it.

During her participation in the program “Gaza...what next?” Guimet Touma, the medical coordinator for Doctors Without Borders in Palestine, reported that the organization's team, which was present at the Nasser Medical Complex, was forced to flee with their families after the occupation forces bombed the complex building and stormed it, which led to the death of a Palestinian and the injury of others.

Touma warned that there are about 400 patients in critical conditions, including those who cannot move, who were evacuated from the hospital at a time when there are no other hospitals that can receive all that number, which puts them at risk of death, and she considers the matter catastrophic.

She pointed out that the infrastructure of medical facilities is clearly targeted, despite the presence of patients and medical staff inside them, which are fundamentally disproportionate to the large numbers of patients, which is absolutely unacceptable, and must be stopped.

is no exception

In this context, Sari Orabi, the writer and political researcher, believes that the Israeli occupation’s policy of targeting health facilities is not exceptional, but rather it is usual even in circumstances different from the aggressive war on Gaza, pointing in this context to the occupation’s storming of Ibn Sina Hospital in Jenin and the assassination of 3 Palestinians. On his family.

He pointed out that the occupation used to violate places that are considered forbidden from a customary standpoint. Such as houses of worship, hospitals, universities, and schools, where there are no taboos in dealing with Palestinians, regardless of the context and level of confrontation.

Hence, Sari believes that the current reality would not be surprising in light of this degree of intent to exterminate the Palestinian people, and the occupation’s aim to destroy civilized life inside the Gaza Strip, prevent any real safe haven there, and make life difficult inside the Strip and turn it into hell, which falls within the framework of practice. The revenge that did not stop.

The political writer believes that the occupation will not stop this practice as long as it does not find anyone to prevent or restrain it, in light of his assessments that his war and his security needs are above all considerations, and his insistence on continuing this war.

Although he appreciates that Israel cares to some extent about its international image, which was shaken after it was accused of committing genocide, he believes that the occupation gives priority to forceful options in dealing with the Palestinians.

Sari adds that the occupation believes that the decisions of the International Court will not affect Israeli strategic and security interests, in light of its view that the Palestinians’ backs are exposed without support in this confrontation.

A clear and absolute violation

In turn, Dr. Saad Jabbar, a lawyer and expert in international law, believes that the occupation’s targeting of health facilities is a clear and absolute violation of what was stated in the ruling of the International Court of Justice, and a violation of all international laws and comes in the context of attacks that fall under the heading of genocide.

In light of Israel's continued violation of the decisions of the International Court of Justice, Saad believes that the International Criminal Court must play a role by having the Public Prosecutor issue an indictment against Israeli officials and demand that they be prosecuted internationally to hold them accountable for these crimes.

He added that countries and organizations that support Israel - especially America, Britain, and the European Union - must stop being satisfied with denunciation and condemnation, and go beyond that by demanding that Israel immediately refrain from committing these crimes, because without their support, it would not have been able to commit these crimes, as he put it.

He pointed out that the presence of another case related to the legitimacy of the Israeli occupation of Palestine, on the agenda of the International Court of Justice next week, would delay consideration of South Africa’s request to the court to warn Israel against the invasion of Rafah, and to attribute its recent violations to evidence of the occupation committing the crime of genocide in Gaza.

However, the element of time is important, according to the expert in international law, and therefore the major countries must take decisions to stop the Israeli massacres against the Palestinians - as he put it - and the Public Prosecutor of the Criminal Court must move and file charges against Israeli officials as he did regarding other officials. .
