On February 2 this year, more than 25 provinces held the written examination for the recruitment of civil servants in 20, and a month later, many places recently intensively announced the results and passing scores of this written test, and at the same time, some provinces announced the cheating of candidates investigated and dealt with in this examination.

Someone banned the exam for 5 years, someone got "-2"

Recently, the Shaanxi Provincial Personnel Examination Center issued an announcement on the handling of violations of discipline and law in the public examination involving more than 140 people.

According to the announcement, in the 2023 provincial examination for civil servants in Shaanxi, 90 applicants were treated as "invalid test results in this subject", and violations of discipline and regulations included bringing items other than the regulations into the examination room and not placing them in the designated position as required, sitting in the wrong seat, not answering with a pen with the prescribed answers, and continuing to answer questions after the exam.

The announcement also introduced that the answer information of the "Administrative Vocational Aptitude Test" of this examination was highly similar, and the two applicants who cheated in the same examination room were treated as "invalid test results in this subject". The four applicants who committed cheating or other acts in the examination room will be given the punishment of "disqualification from this examination and restriction on applying for civil service examination for five years" by the provincial-level civil service department. For the 2 applicants who failed to approve their identity during and after the examination, 4 points were scored in the relevant subjects.

The Shaanxi Provincial Personnel Examination Center also said in the announcement that applicants who have violated discipline and regulations have marked the subject of disciplinary violations in the score inquiry window, and the results of relevant subjects are marked as "-2".

Recently, Liaoning, Ningxia and other provinces have also issued similar public examination cheating announcements.

The announcement in Ningxia also posted the admission ticket number of the cheating candidate. According to the announcement in Liaoning, two candidates who committed serious disciplinary violations, such as "viewing or eavesdropping on texts and audiovisual materials brought into the examination room in violation of regulations" and "taking out of the examination room in violation of regulations, such as examination papers, answer cards (answer sheets), and other materials distributed in the examination room" were given the disqualification of the examination and restricted from applying for the civil service examination for five years.

How will cheating in the civil service examination be handled?

Regarding the handling of violations of discipline in the civil service examination, the new version of the Measures for the Handling of Violations of Discipline in the Recruitment of Civil Servants issued by the Organization Department of the CPC Central Committee and the Ministry of Human Resources and Social Security in September 2021 contains detailed provisions.

Among them, the act of "zero score in the subject (session) test in question" includes bringing items other than those specified into the examination room, failing to put them in the designated position as required after being reminded, failing to take the test at the designated seat, and continuing to answer questions after the test end signal is sent.

The disciplinary violations of "disqualifying this examination and restricting registration for five years" include plagiarizing other people's answer information or assisting others to copy answer information, viewing and eavesdropping on text and audiovisual materials brought into the examination room in violation of regulations, and using prohibited communication equipment or electronic equipment with computing and storage functions.

There are also lifelong restrictions on registration, including using forged, altering or stealing others' resident ID cards, admission tickets and other supporting materials to take the exam, taking the exam on behalf of others or allowing others to take the exam instead of themselves, illegally intruding into the examination information system or illegally acquiring, deleting, modifying, or adding system data.

Compared with other cheating behaviors, the determination of "similar volumes" in the above-mentioned local announcements has attracted considerable attention.

According to the provisions of this document, if it is found that the content of the answers to the same subject between candidates is similar during the examination process, and it is confirmed by the examination expert group on the examination papers, the examination body that specifically organizes and implements the examination will give the applicant a zero score in the examination of the subject (session), and the recruitment procedure will be terminated. The methods and standards for determining the similarity in the content of the answers shall be determined by the examination body at or above the provincial level.

The Ninth Amendment to the Criminal Law, which came into effect in November 2015, clarifies that in statutory national examinations, including civil service examinations, the act of organizing and conducting cheating in examinations is included as a criminal offense, and if the circumstances are serious, it is punishable by fixed-term imprisonment of not less than three years but not more than seven years.
