A hearing-impaired woman in her 80s living in Shizuoka Prefecture sought compensation from the government for being forced to undergo sterilization under the former Eugenic Protection Law. ordered.

This is the fourth similar lawsuit that has been filed across the country, recognizing the state's liability for compensation.

A hearing-impaired woman in her 80s living in Shizuoka Prefecture was forced to undergo a sterilization operation based on the former Eugenic Protection Law in 1970, and has demanded 33 million yen in compensation from the government.

In a ruling on the 24th, presiding judge Yoshinori Masuda of the Shizuoka District Court acknowledged the government's liability for compensation and ordered the plaintiff to pay 16.5 million yen.

At the trial, the plaintiffs suffered severe human rights violations, including being deprived of the right to bear and raise children, and argued that the former Eugenic Protection Law violated the Constitution. It was requested that the lawsuit be dismissed, saying that the right to seek has been extinguished.

This is the fourth judicial decision that recognizes the country's liability for damages in similar cases across the country, following the decisions of the Osaka and Tokyo High Courts last year, and last month's Kumamoto District Court.

Regarding the ruling, the Ministry of Health, Labor and Welfare commented, ``We recognize that the government's claim was not accepted. In the future, we would like to carefully examine the contents of the ruling and discuss with the relevant ministries and agencies and respond appropriately.''
