A state of appreciation and reverence prevailed on the communication platforms in Yemen for one of the well-known tribal sheikhs after he decided to pardon the murderer of his son before the execution of the death sentence against him, out of honor and pity for the murderer’s mother from the situation she reached.

The story, which was monitored by the “Shabakat” program on 2/21/2023, dates back to more than 8 years ago, when the young Rabie Al-Damassi deliberately killed his friend Saddam Al-Qahti.

After 8 years of litigation, it was expected that the court’s ruling against Rabie would be issued at any moment, so the grieving mother resorted to retreating to the cemetery, and erected a tent near the grave of the murdered Saddam, and resided in it for several continuous days accompanied by her young child, as begging the family of murdered to pardon her son.

The mother remained in the cemetery, awaiting the issuance of the verdict and the decision of the family of the dead man. Either she receives the body of her son after the execution of the death sentence against him, or she receives the glad tidings of pardon.

After reciting the final court ruling in the presence of the father of the dead man and a number of sheikhs and notables of the tribe - which stipulated the execution of the death sentence against Rabie by firing squad - Sheikh Abdullah Al-Qahati (the father of the dead man) surprised everyone by announcing a pardon for the murderer of his son for the sake of God Almighty, then he went immediately, accompanied by his relatives. And the elders of the tribe to the cemetery promising the mother of the murderer to pardon her son.

According to the Law of Crimes and Penalties in Yemen, the one who owns qisas has the right to pardon, and if the pardon is issued by those who own it before the ruling in the case, the qisas is dropped, and if it was issued after the ruling in the case of qisas, the execution of the qisas punishment is suspended.

The position of the sheikh of the tribe, Abdullah Al-Qahti, found wide echoes among the members of the Yemeni society, many of whom tweeted praising his stance and chivalry. Moments before execution, he was pardoned.

Amer bin Khurais also praised the position of the dead man's father.

In turn, Hamid Saleh congratulated Rabi`'s mother and praised the generosity of Sheikh Al-Qahati's morals, so he wrote, "Rise up, O Umm Rabi`, for the needs of the honorable are fulfilled."

Khalil Al-Omari praised the position of the dead tribe, saying, "A great position from the Murad tribe and from Ma'rib. This is Yemen and these are its authentic and tolerant tribes."

It is noteworthy that after the waiver of blood guardians - which is the private right - then the general right of the state remains, which is more than 3 years and is determined by the judge, but the murderer Rabie spent about 8 years in prison to end with that general right, that is, he is supposed to be released days after the termination of Administrative procedures.
