In Erquy, in the Côtes-d'Armor, the neighbors of a crêperie have come under heavy criticism from many Internet users.

Their wrong?

Complaining about the noise and crepe smells from the restaurant located right next to their house.

This neighborhood dispute, which has been going on for more than two years, remained confidential until the owners of the Pêcheur creperie launched an online petition which alerted the press.

“I have the feeling that we have made a lot of effort.

We are fed up, we just want to work, ”explained Alex Polge,

With his companion, he invested heavily in an attempt to obtain peace.

Going so far as to dismantle the playhouse installed for the children in order to limit the noise of the customers.

This banal story of a neighborhood quarrel then took another turn.

This Monday, the text of Alex and his companion Marlène had been signed by more than 50,000 people.

Among them, many rise up against the neighbors, who are particularly wrong to be from Paris.

The couple had their second home built in Erquy in 2000 to calm down, before seeing their neighbor transform his house in 2009 into a creperie.

A transformation that raised some problems of cohabitation but nothing more.

Judicial expertise will be requested

The situation became more tense in 2016 when the couple came to settle full-time in Brittany for their retirement.

Since Alex and Marlène took over the restaurant in 2019, things have gotten worse, until an invitation to appear for February 16, unless a dismissal is requested.

“My clients are not asking for a conviction.

They just want to have their rights respected,” explains Me Christophe Samson calmly.

This lawyer specializes in noise-related nuisances.

Everywhere in France, it intervenes to defend people inconvenienced by noise pollution.

“We have a detailed bailiff's report which attests in particular to the nuisances linked to the kitchen extractor.

It is noisy and obviously does not work very well because the smells are still very strong,” explains the lawyer.

The latter will request a judicial expertise in order to establish the existence, or not, of the nuisances.

“We need to be able to know if they are acceptable in the eyes of the law,” continues the lawyer.

The problem is, installing the extractor was supposed to fix the pancake smell, which it does visibly quite badly and noisily.

A first attempt at conciliation had failed at the end of the year, but the neighbors' council is still desperate to find an amicable solution.

The request for a closing at 7 p.m. by the complainants had not pleased the restaurateurs, who had refused.

“My neighbors are not angry.

They are not waiting for the establishment to close, they are just asking to be able to live normally, ”explains the advice of the retired couple.

On the other side of the fence, the restaurateurs also brought in a lawyer to defend their case.

And hope to be able to reopen serenely in February, when the extension work on their veranda will be completed.
