The man's bereaved family argued that the tree fell because of a management problem, and demanded compensation from the city of Kumamoto, which manages the prefectural road, and the owner of the land where the tree was located. acknowledged the appeal, saying, ``It is the city's duty to take measures to prevent trees from falling on the roads it manages from surrounding private property.''



In addition, the Fukuoka High Court of the second trial also ordered the city and the owner to pay compensation of about 50 million yen, saying that ``the tree could have been predicted to fall on the road''.



Kumamoto City filed an appeal against the ruling, but presiding judge Atsushi Yamaguchi of the First Petty Bench of the Supreme Court decided to reject the appeal by the 26th, confirming the city's loss.
