It was a mother who launched the alert on Facebook by posting a photo of her college son having lunch in his car rather than in the canteen.

One way to highlight the situation of students with disabilities who can no longer benefit from an accompanying person at noon for institutional reasons.

"When I learned that my son could no longer have his AESH [accompanying students with disabilities] in the canteen like last year, I collapsed," says Claire Lambert, mother of a boy from 11 years old, with multiple disabilities, educated in a private Catholic college in Pornichet (Loire-Atlantique), at the origin of the message.

A decision of the Council of State of November 20, 2020 specifies that AESH are financed by the State during school time and, during extracurricular time, by local authorities, which are gradually taking over this responsibility.

However, no support is provided for students in private education.

"As I couldn't stop working, we took the decision to finance our son's AESH ourselves on canteen time, which amounts to nearly 200 euros per month", explains the one who has just created the collective “School inclusion in danger” on Facebook, which brings together 70 families and is considering taking the case to court.

An "impossible situation" for the municipalities

According to the Assembly of the departments of France (ADF), the students concerned are “a few dozen” per department.

This judgment of the Council of State "totally contravenes the principle of educational continuity for the child, by operating a partitioning between school and extracurricular", denounces the ADF.

Co-president of the education commission of the association of mayors of France (AMF), the mayor of Arras Frédéric Leturque points to “an institutional decision very far removed from the realities experienced by children, parents and community agents”.

"The Council of State places us in an impossible situation, especially in small towns which do not have the means", deplores the elected official.

In a letter sent on February 11, 2022 to the Prime Minister, the associations representing the municipalities, the departments and the regions considered that recruiting and remunerating AESH "must be the sole responsibility of the State".

What solutions?

According to the Ministry of National Education, 6 to 7% of children with human assistance in class also benefit from it during extracurricular time and before this court decision “local situations were very variable”.

"Aware of the concrete difficulties for the establishments, the families and the pupils concerned", we indicate, rue de Grenelle, to propose "in particular contracts with a single employer [National Education] including a provision on the meridian break against reimbursement by the entity responsible for extracurricular support".



The ministry responsible for people with disabilities specifies that discussions are taking place with the communities “so that there is no longer a situation of non-support”.

The assistant to the general secretariat for Catholic education Yann Diraison believes that "the only solution would be for the State to take responsibility for it, given the 2005 law on inclusion and the need for these students to have the same guide on the day.
