The company was fined 185,015 yuan for selling nucleic acid testing group purchase coupons through the Meituan App without implementing the government’s guidance price, and using false or misleading price methods to trick consumers or other operators into trading with it.
The publicized illegal facts show that Beijing Beiji Medical Laboratory Co., Ltd. began to sell nucleic acid testing group purchase coupons through the Meituan App on February 18 this year.
When the company sells 40 yuan/time Beiji nucleic acid testing group purchase coupons, it will give consumers a 5 yuan coupon that is used by default. The company can only use one 5 yuan coupon per order.
On March 18 this year, the company sold two 40 yuan/time Beiji nucleic acid testing group purchase coupons in one order, but there is only one 5 yuan coupon by default, and each group purchase coupon is only discounted by 2.5 yuan, so the group purchase The unit price of the coupons is 37.5 yuan/time.
On March 30 this year, the company sold a group purchase coupon for nucleic acid testing throat swabs at a unit price of 40 yuan per time.
According to the "Notice on Further Reducing the Price of Novel Coronavirus Nucleic Acid Testing Items", the price of the new coronavirus nucleic acid testing item is the government-guided price, and the guide price is 35 yuan per time, and the implementation time is from December 11, 2021.
According to the "Notice on Reducing the Price of Novel Coronavirus Nucleic Acid Testing Items", the price of the new coronavirus nucleic acid testing item is 24.9 yuan per time as guided by the government from April 9 this year.
Therefore, during the period from December 11, 2021 to April 8, 2022, the price of nucleic acid testing group purchase coupons sold by the company should not be higher than 35 yuan per time.
The company sold 2 nucleic acid testing group purchase coupons at a price of 37.5 yuan per time, and sold 1 nucleic acid testing group purchase coupon at a price of 40 yuan per time.
In addition, the company used the price of 40 yuan per time as the price reduction benchmark when selling Beiji nucleic acid testing group purchase coupons from February 18 to April 1 this year, and gave consumers a 5 yuan coupon for each order.
The nucleic acid test price is the government-guided price, with a maximum of 35 yuan per time. There is no such thing as the company's marked price of 40 yuan per time and a discount of 5 yuan.
Therefore, the behavior of the company belongs to the use of false or misleading price means to deceive consumers or other operators to conduct transactions with it.
The Shijingshan District Market Supervision Bureau ordered Beijing Beiji Medical Laboratory Co., Ltd. to correct its illegal behavior and fined it 185,015 yuan.
