The Egyptian Public Prosecution in response to the judge accused of killing his wife: The conditions for self-defense are not met!

The Egyptian Public Prosecution responded to the statements of Judge Ayman Hajjaj, who is accused of killing his media wife, Shaima Gamal, jointly with his friend Hussein Al-Gharabli, and burying her body in southern Giza.

This comes after Judge Ayman Hajjaj repudiated his oral statements, and attributed his perpetration of the crime to the fact that “he was in a state of legitimate self-defense, when the victim tried to assault him with a fruit knife and a can of money,” and that “he only managed to take out his tab and hit her with the backside 3 times on the When she died, he carried the body with his friend and put it in a pit in a farm in the village of Abu Sir in Badrashin, south of Giza.

In the decision to refer the defendants to the “crimes”, the Public Prosecution clarified, saying: “The accused Ayman tried to stave off the accusation against himself by inserting another picture into the incident in which he was imprisoned with no intention to take the life and premeditated circumstances and permitted his act under the umbrella of the legitimate defense of life, by saying that he was against The victim was harmed by the poor condition of the farm, which he offered her to own, and she attacked him with a knife, so he grabbed her hand and hit her with the body of the firearm on her head, so he dropped the knife from her hand, then tried to wake her up. She was decorating her neck with it, to silence her screaming, and the other accused entered the room at the time to encircle her arms until she died, explaining his intention to prevent her screaming for fear of revealing the matter and not taking her soul.

And the Public Prosecution added: “By putting this photograph on the table for investigation and investigation, we find that he was smitten in his cradle, as it resembled something like unreasonableness, and there was no material or verbal evidence to support him, as the knife referred to in the scene of the incident was not seized, and no injuries were seen in the accused. About attacking the victim, not to mention that he did not promote that idea when he presented the incident to his acquaintances who sheltered him before he was arrested and presented to the Public Prosecution. In the statements of any of those who quoted him as a male, in addition to the fact that by confronting him with that photograph, he denied it altogether, in addition to that, the accused who adhered to that plea had not referred to these events from near or far during his oral declaration before the Public Prosecution, so the idea of sticking to it came only during his interrogation. Then acknowledgment."

The Public Prosecution considered that these statements “are nothing but a desperate and truncated attempt to mitigate the punishment of his crime, not to mention that the premeditation is available to the accused, which means the exclusion of his payment, that he was in a state of legitimate defense, as the defense assumes the surprise of the assault and the urgent necessity to perform the act of defense. while premeditation means the quiet, unhurried measure of the criminal act."

She added, according to "Al-Masry Al-Youm", that:Assuming the truthfulness of his narration - and it is a dialectical imposition that has no share in reality - the elements and conditions of the legitimate defense have been omitted from the papers, the verse of that, and his evidence is that by reviewing the facts of that depiction, we find that he was able to ward off the attack of the victim from him without causing him any harm, and the knife used in the attack fell. The alleged attempt to assault her from her hand when he was in control of her, and he had a firearm in his hand, and the surrounding circumstances made it possible for him to prevent danger, either by threatening her with the firearm in his possession or continuing to control her while keeping the alleged knife out of her reach. Her choice to ward off that alleged danger is to hold her breath and close her neck - with the intervention of the other accused and encircling her arms from behind, according to his alleged narration - a picture in which we find two adult men, one of whom crouches with his weight on a woman sitting on the ground and the other encircles her arms from behind for a period of ten minutes, including It negates any degree of danger to any of the accused that would allow them to commit any assaultThe victim is under the umbrella of legitimate defence, which negates the reason for the aforementioned permissibility.”
