  On the eve of the International Anti-Drug Day on June 26, Shanghai Pudong New District People's Procuratorate (hereinafter referred to as "Pudong Procuratorate") and Jing'an District People's Procuratorate (hereinafter referred to as "Jing'an Procuratorate") successively issued white papers on drug-related criminal prosecution work and drug-related crime cases, revealing The new trend of drug crimes in recent years: high incidence of drug crimes by express delivery; high incidence of new drug cases; more cases of minors and young people buying drugs online out of curiosity.

  Lin Moumou, a second-year high school student in Jiangxi Province, purchased marijuana from abroad three times from January to March 2019, and the express package was seized by Pudong Customs when it entered the country.

The two packets of yellow-green solids in the package weighed a total of 262.09 grams, and THC was detected in both.

  Lin was under the age of 18 at the time of the incident.

According to the prosecutor handling the case, Lin Moumou not only bought marijuana online, but also resold it to others for smoking on campus.

Lin Moumou was prosecuted by the Pudong Procuratorate for smuggling and drug trafficking, and was later sentenced by the court to 1 year and 6 months in prison and a fine of 1,500 yuan.

  The prosecutor who handled the case told reporters that Lin Moumou first became curious when he heard people describe smoking marijuana on the Internet, and gradually developed into smuggling and drug trafficking, and embarked on the criminal path of "trafficking and smoking", "This warns parents that they must fulfill their guardianship responsibilities. , so that children are not induced by bad information on the Internet, strengthen the supervision of the behavior of minors, and teach them to cherish life and stay away from drugs.”

  In 2021, the Pudong Procuratorate will handle 35 drug-related cases in logistics delivery channels, involving various forms such as ordinary express and international parcels.

Trafficking groups (or persons) have shifted from professional traffickers in the traditional sense to the "zero-package bulk" type by delivery.

There are various ways of disguising drug trafficking. Traditional drugs are generally delivered in the form of books or bags, while new drugs are mostly delivered directly in the form of medicines or electronic cigarettes.

The virtual nature of the Internet world, the anonymity of identity accounts, and the "separation of people and goods" and "separation of time and space" in drug transactions have brought challenges to the handling of cases.

  In the past five years, the overall number of drug crimes prosecuted by the Jing’an Procuratorate has shown a downward trend year by year, but the number of drug trafficking crimes committed through delivery channels has shown an increasing trend year by year, accounting for 6.0% of the total drug cases in 2017. 36.4% in 2021 %.

Among the drug delivery cases in the city, 83.3% of the cases used the same-city “flash delivery” and “run errands” to deliver drugs. There are still blind spots in the supervision of new logistics formats such as smart express cabinets and “flash delivery”.

The defendants in drug delivery cases tend to be younger, and 49.1% of the defendants in such cases are under the age of 30.

  The prosecutor of the Jing'an Procuratorate also told reporters that in the past two years, new psychoactive substances such as "Smurfs", "rhino liquid" and "electronic cigarettes" have appeared in the delivered drugs.

The four cases involving the delivery of narcotics handled by the Jing'an Procuratorate in 2021 are all cases of trafficking in synthetic cannabinoids.

  From July to August 2021, 35-year-old Zhang Moumou sold electronic cigarettes containing synthetic cannabinoids to Min Moumou five times by way of door-to-door delivery, knowing that there was a problem with the e-liquid he sold.

The People's Court of Shanghai Pudong New Area sentenced Zhang Moumou to 3 years in prison, suspended for 3 years, and a fine of 10,000 yuan for the crime of drug trafficking.

  The prosecutor of the Pudong Procuratorate told reporters that "electronic cigarettes" have become the main carrier of synthetic cannabinoids, and WeChat, express delivery, and flash delivery have become the main tools for drug trafficking, relying on express delivery, flash delivery, "errands" and other logistics services. The method is concealed, the circulation speed is fast, and the circulation range is wide.

  Prosecutors said that the express delivery industry should strictly implement all inspections and improve the ability of employees to recognize and identify drugs.

The Jing'an Procuratorate once co-signed the "Opinions on Establishing a Linkage Mechanism for Postal Supervision Administrative Law Enforcement and Procuratorial Supervision" in conjunction with the postal administration department to form a joint supervision force.
