Satoshi Umehara, who was a teacher at a prefectural high school in Osaka, hoped to be reappointed after retirement in December 2016, and after that, the principal confirmed whether he would follow the orders of his boss, including standing up in a chorus of his generation. After that, he was rejected and asked the prefecture for compensation, saying that he had violated the freedom of thought and conscience guaranteed by the Constitution.



When Mr. Umehara was an active teacher, he was disciplined twice for admonition because he did not sing the national anthem.



The first trial dismissed the complaint, but the Osaka High Court of the second trial said last year that another teacher who had been disciplined for a "pay reduction" heavier than Mr. Umehara was reappointed last year. It is illegal because of the irrational response, "he ordered the prefecture to compensate for more than 3 million yen.



On the other hand, it was judged that it was not illegal to confirm the intention to comply with the order including standing up.



The prefectural government had appealed the judgment, but Ryosuke Yasunami, the judge of the Supreme Court's First Small Court, decided to dismiss it by the 17th, and the judgment of the two courts that ordered the prefectural government to compensate was finalized.
