Defendant Wang Linqing was sentenced to ten years in prison and a fine of one million yuan for the crime of accepting bribes, and five years in prison for the crime of illegally obtaining state secrets. The property obtained from bribery and its fruits shall be recovered in accordance with the law and turned over to the state treasury.

  The Beijing No. 2 Intermediate People's Court heard the Wang Linqing case in accordance with the law on October 26 and 27, 2021. Among them, a public hearing was held on the fact that Wang Linqing was accused of accepting bribes, and the fact that Wang Linqing was accused of illegally obtaining state secrets involved state secrets. Some of the hearings are held in private.

During the trial, the procuratorate presented relevant evidence, the defendant and the defender cross-examined, the prosecution and defense both expressed their arguments, and the defendant made a final statement.

  After the trial, it was found that: from 2008 to 2018, the defendant Wang Linqing took advantage of the convenience of serving as an assistant judge of the First Civil Division of the Supreme People's Court or the convenience of the formation of power and status, alone or in conjunction with others, to act for relevant units and individuals in the case. Provide assistance in the trial and other matters, and illegally accept property from 2 units including Yulin Kaiqilai Energy Investment Co., Ltd. (hereinafter referred to as Kaiqilai Company) and 11 individuals including lawyer Cheng Jie and lawyer Yang Ming, which is equivalent to RMB 21.9 million. Among them, Yu Yuan, from 2011 to 2018, provided assistance to Kaiqilai Company in matters such as the trial and execution of the case, and received a shopping card of USD 50,000 and RMB 50,000 from Zhao Faqi, the legal representative of the company, A total of more than 350,000 yuan.

  From June to August 2018, under the instigation of Zhao Faqi, the defendant, Wang Linqing, agreed that Wang Linqing should obtain the dossier materials of the case of the dispute over the exploration contract between the Kaqilai Company and the Xi'an Geological and Mineral Exploration and Development Institute of the Shaanxi Provincial Bureau of Geology and Mineral Exploration and Development.

Wang Linqing successively used borrowing, fraudulently obtained dossier materials and then secretly photographed them to illegally obtain a large number of dossier materials in the case of Kaqilai Company, and provided the photographed materials to Zhao Faqi through mobile phone WeChat or email.

According to the identification by the State Security Bureau, 5 of the materials illegally obtained by Wang Linqing and Zhao Faqi were classified as state secrets.

  The Beijing No. 2 Intermediate People's Court held that the defendant Wang Linqing, as a state functionary, took advantage of his position to seek benefits for others, or took advantage of the convenient conditions formed by his power and status, and through the behaviors of other state functionaries in his position, to serve his purpose. Others seek illegitimate interests, illegally accept other people's property, the amount is particularly huge, and their behavior constitutes the crime of accepting bribes; illegally obtaining state secrets by stealing methods, if the circumstances are serious, their behavior constitutes the crime of illegally obtaining state secrets.

As a judicial staff member, Wang Linqing knew the law and violated the law. The amount of bribes he received was particularly large, which seriously violated the integrity of judicial behavior and undermined the credibility of the judiciary. He illegally obtained state secrets and handed them over to Zhao Faqi to be spread, causing bad social impact and should be punished according to law. .

Since he was arrested on suspicion of illegally obtaining state secrets, he took the initiative to explain all the facts of the crime of accepting bribes that the case-handling authorities had not yet grasped, and he had surrendered himself; he pleaded guilty to the crime of accepting bribes and repented. If the punishment is light, the crime of accepting bribes may be given a light punishment according to law.
