And he added in his talk to the episode (11/4/2022) of the “Shari’a and Life in Ramadan” program that after the death of the Messenger, may God’s prayers and peace be upon him, the most knowledgeable and understanding companions of the religion issued a fatwa, and after them the followers and scholars to this day, and the purpose of the fatwa is to explain to people the way of their lives In accordance with Sharia, so that they are not separated from life or Sharia or mix between them.
He also said that the followers laid foundations for the fatwa and turned it into a science that needs many conditions, and it established interpretations, doctrines and schools, and was divided between those who seek to achieve the Qur’anic text, and others who see what serves the purposes of Sharia and walk with it, and people have differentiated between the purposes and texts throughout Islamic history.
Mufti Conditions
Regarding the conditions that must be met by the mufti, the Dean of the College of Sharia confirmed that muftis today are divided into several types: the first teaches the science of Islamic law, the second has the knowledge of reality, the third combines the two sciences, and the fourth does not know anything and seeks to mislead people.
Al-Ansari stated that whoever combines legal knowledge with reality is the one who should take the lead in issuing fatwas, but through institutions or groups specific to fatwas, noting that a large number of scholars today are familiar with Islamic law, but they lack knowledge of reality, justifying this by the abundance and complexity of the sciences of reality and (the matter) is not shortcomings of the scholars themselves.
He stressed the need for scholars not to risk fatwas, especially in this era, until after verifying the consequences of the fatwa and seeking a scientific opinion in the same field.
