• A construction site for 25 high-end tourist huts had been planned for many months on the shores of Lake Montbel, in Ariège.

  • A private project denounced by environmental associations who defended the presence on the premises of many protected species and had filed an interim order against the development permit issued by the town hall.

  • A license suspended in summary by the administrative court which considers that the promoters cannot exempt themselves from a detailed impact study.

The ecotourism project provided for the establishment of 25 top-of-the-range huts on stilts, located on the banks of Lake Montbel, in Ariège, 1h30 from Toulouse.

Carried by a company specializing in unusual accommodation, it provided for the construction on private land of these accommodations, but also of parking spaces and an infinity pool.

A project that quickly aroused an outcry from environmental defense associations, attached to the 129 protected species present on the Montbel site.

They have just won their case with the administrative court of Toulouse, which has just suspended in summary proceedings the planning permit issued on June 16, 2021 by the mayor of the town.

Impact study

With reference to the Environment Code, the judge considers that the impact assessment carried out as part of this project is insufficient and that a real impact study should have been carried out.

The administrative judge also refers to the Regional Environmental Authority Mission, which, in its two opinions issued on the revision of the Montbel local urban plan, had expressed significant reservations about the lack of justification for the choice made for the location of the project.

But also "on the need to significantly complete the report in order to establish that the choices made make it possible to avoid significant impacts on the environment and the protected species and habitats and to implement strict measures, through regulatory zoning adapted, making it impossible to deteriorate sectors at stake".

For the administrative court "the absence of this impact study could have been such as to exert an influence on the issuance of the planning permit".

The huts, whose construction was envisaged at the end of last year, will therefore not be able to see the light of day before the examination of the legality of the planning permission by the same court in the coming months.
