  In February 2021, a man named Liu Fei was arrested by the public security organs in a rental house in Beijing on suspicion of robbing ancient tombs.

Unexpectedly, among Liu Fei's belongings, the police found a handwritten note with a thickness of several hundred pages, which recorded various information related to ancient tombs.

On January 28, 2022, the Beijing Haidian District People's Court heard the case in public, and Liu Fei was one of the 13 defendants in the case.

  According to the confession of the defendant Liu Fei, the owner of this tomb robbery note, he has always had a strong interest in the tomb robbery stories described in the book, and imagined that he would have the opportunity to try it for himself.

  Defendant Liu Fei: Around the time of summer and autumn of 2020, when we were working in Taiyuan, we met a liar. The liar allegedly would dig up ancient tombs, and then wanted to bring me in to steal the ancient tombs together, and asked me to pay for him Food and drink, so I paid him a few thousand yuan for food and drink. At that time, I learned Li Wa's mobile phone number through this liar, and through that liar, I learned that Li Wa is a real tomb robber.

  By chance in 2020, Liu Fei heard someone introduce a person called Li Wa, and also heard that he really knew how to rob tombs, so he took the initiative to get acquainted.

  Defendant Liu Fei: After three or four months, about winter, I contacted Li Wa on the phone. I told Li Wa on the phone that I would be involved in the theft of ancient tombs. It doesn’t matter if I make money or not. I have no technical knowledge, but I have no problem working hard.

  Li Wa, whose real name is Li Zhihong, was sentenced to one year and six months in prison by the Zuoyun County People's Court of Shanxi Province on June 16, 2014 for the crime of robbing ancient tombs.

But in the eyes of Liu Fei, who was thinking about robbing tombs, Li Zhihong knew how to look at tombs, so he wanted to get together and make a big vote.

At the same time, another person also found Li Zhihong, a man nicknamed "Pigeon", and said he wanted him to visit the tomb in Beijing.

 Several people conspired to speculate that there are ancient tombs on the mountain

  "Pigeon", whose real name is Wang Junqi, is also one of the defendants in the court.

At that time, Wang Junqi thought that there might be a tomb on a mountain in Haidian District, Beijing. So how did this idea come about?

It turned out that before that, Wang Junqi got acquainted with Li Qinghe, another defendant in the case, and they went to a hillside in Haidian District, Beijing to see the scene together, thinking that there were tombs there, so they had evil thoughts.

After pre-planning, several people formed a tomb robbery gang

  With the addition of several members one after another, an organized tomb robbery gang with a clear division of labor was formed.

And the hillside they discovered before became the first place they robbed the tombs.

  After arriving in Beijing, Li Zhihong was taken by Wang Junqi to the mountain in Haidian District, Beijing that he had been to before. After some investigation, they tried to find the specific location of the excavated tomb.

  Defendant Li Zhihong: Not far from an entrance of the West Sixth Ring Road, on the edge of the train track, I saw two broken stone tablets there. The large stone tablet is like a tomb. To the north of the tomb is the woods, so I decided to start digging at a place four meters away from the woods.

  On what basis did Li Zhihong determine that there was a tomb nearby?

  Defendant Li Zhihong: The basis for my judgment is that I saw two broken stone steles. There is a large mountain about 200 meters to the west of the steles. I think there will be tombs under the mountain, and the woods on the north side of the mountain will help us when digging tombs. Hidden, for no other reason.

  In this way, Li Zhihong and Wang Junqi determined the location of the tomb robbery and immediately began to form a tomb robbery gang.

  Defendant Liu Fei: About a month before the Spring Festival in 2021, Li Wa (Li Zhihong) called me and told me that there was an ancient tomb robbery in Beijing and asked me to come and see it. I couldn't find anything good and asked me if I would like to come and try it, and said that I would pay for the toll by myself. After hearing that, I said yes, so I rushed from my hometown to Beijing at my own expense.

  After receiving the call from Li Zhihong, Liu Fei felt that his chance to do a big business had finally come, so he bought a ticket and went to Beijing to meet Li Zhihong and others.

  Defendant Liu Fei: I met Li Wa (Li Zhihong) for the first time there, and Li Wa (Li Zhihong) told me to work first, listen to the command, talk less and do more work, and don’t be blind if you shouldn’t ask. ask.

Pigeon (Wang Junqi) is the boss of the gang, and Li Wa (Li Zhihong) is the oldest in the gang. The two of them told me that the last thing to divide the spoils is that if we dug up something, everyone will share it equally.

The six met to prepare for the action to find the staff of the forest farm to join

  In this way, Liu Fei and other six people gathered together one after another, and after two days of repairs, they were ready to start their operations.

And in order to hide people's eyes and ears, Li Qinghe also brought in a person who could work in his opinion.

This person's name is Li Chen, a staff member of the forest farm near the site where they planned to rob the tomb.

  Defendant Li Chen: I met Li Qinghe around 2015. In October 2020, Li Qinghe called me and said that he was going to work on the mountain. I asked what he was doing. Li Qinghe told me that it was a tomb robbery and told me his The tomb site was also asked if I was under the jurisdiction of my unit.

Later, I went to check the location where Li Qinghe robbed the tomb. I determined that the location was not under the jurisdiction of my unit, and then Li Qinghe found a group of people to start robbing the tomb.

  In order to cover the tomb robbery, Li Qinghe asked Li Chen to borrow the walkie-talkie and clothes of the forest ranger in his forest farm to disguise.

  Defendant Li Chen: Li Qinghe borrowed a walkie-talkie from my unit from me. Li Qinghe meant that when he robbed the tomb, he wore the two sets of forest ranger clothes I gave him before, and brought a walkie-talkie from our unit. The tomb robber played the role of The forest ranger was patrolling the forest normally. Li Qinghe promised to give me some favors, so I lent a walkie-talkie from the unit to Li Qinghe.

  After introduction, he hired four more people disguised as rangers to look out for the wind.

  In this way, Li Qinghe solved the tomb robbery tool and temporary residence through the relationship of this forest farm staff member, and hired Wang Wenqing and other four people through the introduction of this person, disguised as forest rangers to watch the wind around the tomb robbery site.

  Although Li Qinghe had not stated it clearly before, Wang Wenqing, who was in charge of the lookout, and the other four still clearly knew the purpose of their coming to the hillside at night.

  Defendant Wang Wenqing: Li Qinghe first told me to ask me to find two or three people to watch private cars and strangers. Later, after the New Year, I knew it was a tomb robbery. Li Qinghe said it was a treasure hunt, so I asked him if it was a tomb robbery. , he said it was almost done.

  The 13-person tomb robbery gang was formed and the division of labor was clear

  On the other side, Wang Junqi stayed behind to command and arrange in the rental house, and a team of 13 people was formed in this way.

  Li Qinghe and Wang Junqi were responsible for the organization and coordination, Liu Fei and other five people were responsible for digging the robbery hole, Wang Wenqing and other four people were distributed around to let the wind out, Yang Jun was responsible for transporting the gang members as the driver, and Li Chen was responsible for providing tools to cover up the tomb.

 Tomb robbers gang out at night to dig holes

  After the formation of the 13-member tomb robbery gang, Li Zhihong, Liu Fei and others started digging and robbing holes at night.

Liu Fei and his accomplices set off from the rental house at seven or eight every night.

When they came to the excavation site and dug until 4 in the morning, the driver would pick them up again to rest.

  In this way, Liu Fei and others dug continuously for more than 20 days in the silent mountain on a cold winter night.

  After the vertical digging was almost finished, the group stopped work to prepare for the New Year. After the New Year, the original team rushed back to Beijing and began to dig horizontally.

However, what they don't know is that the behavior that they think is hidden has already entered the police's sight.

  Not long after their robbery this time, the public security organs arrested the 13-member tomb robbery gang and brought them to justice.

 13 people in the gang were prosecuted and how the court will decide

  After Wang Junqi and other 13 people were arrested, they were prosecuted by the People's Procuratorate of Haidian District, Beijing, on suspicion of the crime of robbing ancient tombs.

In fact, they have been busy for dozens of days without getting the results they imagined.

So what will the court ultimately decide?

  The People's Court of Haidian District, Beijing held a public hearing on the case.

Liu Fei, who was originally obsessed with wanting to find out about ancient tombs and wrote "Notes on Tomb Robbers", together with his accomplices, became the accused of the crime of robbing ancient tombs.

 After pre-planning the defendant's division of labor, the tomb robbery was clearly carried out

  According to the Beijing Haidian District People's Procuratorate, from December 2020 to February 2021, the defendants Li Qinghe and Wang Junqi pre-planned, and the above two people and the defendant Li Zhihong went to a hillside in Sujiatuo Town, Haidian District, Beijing to investigate. Judging from the topography of the scene and the debris of the building, there may be ancient tombs in the Ming and Qing dynasties at the site of the crime.

  Afterwards, the defendants Wang Junqi and Li Qinghe organized personnel to carry out criminal activities such as robbery and digging near the crime site. Among them, five defendants, including Li Zhihong and Liu Fei, went to the crime site to dig holes. The defendant Yang Jun was responsible for transporting Li Zhihong and others to the scene. Defendant Wang Wenqing and other 4 persons were in charge of looking out for the wind around the scene. Defendant Li Chen provided tools, cover clothes, walkie-talkies, etc. for the robbery.

  As of the time of his arrest, a robbery hole with a vertical length of 11.35 meters, a length of 1.5 meters and a width of 0.7 meters had been drilled at the scene, and a tunnel 5 meters to the south and 3 meters to the north had been drilled in the hole.

  The robbery hole dug by the defendant is more than ten meters deep, so is the site where they excavated the site of an ancient tomb?

What kind of impact will such poaching have?

  Prosecutor: The first is the appraisal report on the cultural relics involved in the case, which proves that the appraisal was carried out by the Beijing Institute of Ancient Architecture on the robbed tombs of Dagong Village, Sujiatuo Town, Haidian District. The holes were not punched in the remains of ancient tombs and ancient ruins.

The second point is that based on the information currently available, it is inferred that there were ancient tombs of the Ming Dynasty buried in the history of this area.

  Prosecutor: He should be held criminally responsible for the crime of robbing ancient tombs

  The public prosecution agency believes that the behavior of the defendant Wang Junqi and other 13 people has violated the provisions of Article 328 of the Criminal Law of the People's Republic of China. The facts of the crime are clear and the evidence is indeed sufficient. The 13 people should be held criminally responsible for the crime of robbing ancient tombs.

  During the trial, the 13 defendants had no objection to the charges and facts charged by the procuratorate, and all pleaded guilty.

The defenders of the ten defendants, including Li Qinghe, believed that they played a secondary role of assistance in this case and should be accomplices.

 13 defendants were sentenced separately for the crime of robbery and digging ancient tombs

  In February 2022, the People's Court of Haidian District, Beijing pronounced the verdict on the case.

The court held that the defendant Li Qinghe and other 13 people robbed ancient tombs with historical value, and their behavior constituted the crime of robbing ancient tombs and should be punished.

The Haidian District People's Procuratorate of Beijing accused the defendant Li Qinghe and other 13 people of committing the crime of robbery and digging ancient tombs.

Defendant Li Qinghe and other 13 people have started to commit crimes, but failed due to reasons other than their will, which is an attempted crime.

  Regarding the defense opinions of the ten defendants including Li Qinghe, who claimed that they were all accomplices, the court held that the 13 defendants in this case aimed to excavate ancient tombs. , divided the responsibilities and cooperated with each other to jointly carry out the robbery and excavation. The behavior of each defendant played a major role, so the defense opinion of the defender was not adopted.

  In the first instance, the court held that each of the 13 defendants constituted the crime of robbing ancient tombs, and sentenced defendants Li Qinghe and Wang Junqi to imprisonment for one year and six months respectively.

The defendant Liu Fei was sentenced to one year and two months in prison, and the remaining 10 defendants were sentenced to one year and five months in prison to one year in prison and fined.
