Opponents of the demolition of the National Theater of Nice (TNN) hoped to put a stop to the plan of the mayor of Nice, Christian Estrosi, to extend the Paillon promenade.
But their appeal was rejected, learned
20 Minutes
this Thursday from the Nice administrative court.
The summary sought to request the suspension of "the execution of a decision of the Nice municipal council of December 10 approving the decommissioning and early decommissioning of the building and approving its demolition", recalls the court.
It was introduced by the "Association for the Defense of the Promenade des Arts-Yves Bayard" and by Martine Bayars, the daughter of the latter, architect of the TNN.
No “emergency condition”
The judge considered that “the condition of urgency, mandatory for an interim suspension, [was] not fulfilled”.
“The disputed deliberation declassifies the building of the national theater of Nice from the communal public domain but does not authorize the demolition work of this building.
The demolition proceeds from the only demolition permit which falls under the jurisdiction of the mayor of Nice “and which was issued on January 19, explains the jurisdiction.
At the beginning of the week, the mayor of Nice unveiled the visuals of the extension of the promenade du Paillon, 8 hectares of greenery which will notably cover the area of the National Theater of Nice.
Its demolition should begin in the coming days and be completed by the end of the year.
