New legal victory for
Atresmedia
: the commercial court number 8 of Barcelona has dismissed the lawsuit filed by the Dutch company
MC&F
against
Atresmedia
and
ITV Studios
for ownership of the intellectual property rights of
El Rosco Final

In a ruling to which El Mundo has had access, the court dismisses in its entirety the lawsuit filed by the Dutch company against the Spanish media group and the English production company that owns the rights to
El Rosco
for unfair competition, since it does not consider proven "the authorship and originality of the television game".

F claimed ownership of the intellectual property rights over the format of the most famous test of
Pasapalabra
and judicially requested that its broadcast be prohibited and that any recording of the game be withdrawn from commerce and destroyed, in addition to compensation for "damages caused by infringement" of intellectual property rights and unfair competition.
A decade of judicial dispute
El Rosco
de
Pasapalabra
returned to court last December, after more than a decade of dispute between production companies and television media for the broadcast in Spain of the successful program.
The programme, modeled on the Italian space
Passaparola
, landed on Spanish television in 2000:
Antena 3
broadcast it until 2006, but a year later it moved to Telecinco.
Pasapalabra
was already the subject of a first legal dispute that was settled in October 2019, when the Supreme Court forced
Telecinco
to stop broadcasting the program after losing the lawsuit that the network -
Mediaset España Comunicación, SA
- had filed in 2010 against the British company ITV, as a result of a conflict with this production company.
The reason for that lawsuit was a letter that the company received from
MC&F
informing it that it held the license for
El Rosco
, for which it decided to sign a contract with that Dutch company and take
ITV
to court, alleging that it did not own the rights from space.
After its victory in court,
ITV
transferred
the rights to the program to
Atresmedia and
Antena 3
re-broadcast the program on May 13, 2020, in the midst of the coronavirus pandemic.
When the broadcasts of the contest began two months ago, the Dutch company
MC&F
had filed the lawsuit, now dismissed, in which it established itself as the creator and owner of the intellectual property rights of
El Rosco.
Realizing that Antena 3 programmed
Pasapalabra
daily , despite the lawsuit filed to prevent it, MC&F urged the judge to precautionary suspend the broadcast of the final test
El Rosco
while he resolved on the merits of the issue, but his request was rejected.
