Jiangsu special legislation to strengthen public transport security management prohibits seat domination, grabbing the steering wheel, etc. There are laws to follow

Recently, the Standing Committee of the Provincial People's Congress reviewed and approved the "Jiangsu Provincial Public Transportation Public Security Administration Regulations", which will come into force on May 1 this year.

This legislation seeks to strengthen the legal defense line of public transportation public security management through systematic system design, which provides legal responses to hot issues such as grabbing the steering wheel of buses, conflicts between drivers and passengers, and qualification examination of online car-hailing drivers.

Public transport security management in our province faces multiple pressures

Since the "Thirteenth Five-Year Plan", public transportation in our province has developed rapidly.

Up to now, 5 districts and cities in Jiangsu have opened and operated 26 subway lines, with an operating mileage of 870 kilometers.

During the "14th Five-Year Plan" period, our province will actively build a multi-level and multi-mode urban public transportation system. By 2025, about 40 new comprehensive passenger transport hubs will be built, and the coverage rate of nodes at the county level and above will reach 60%. More than 200 kilometers of new urban rail transit lines will be added, with a total mileage of more than 1,000 kilometers.

The rapid development of public transportation has brought enormous pressure to public safety.

According to Chen Yufeng, head of the Internal Security Corps of the Provincial Public Security Department, since 2010, dozens of criminal cases have occurred in some parts of the country, including arson, explosion, hijacking, and robbing the steering wheel of a moving vehicle, resulting in heavy casualties and property. loss.

Since 2020, the province's public security organs have investigated and dealt with 68 cases of impeding safe driving in which passengers beat the bus driver and grabbed the steering wheel of a running bus, and arrested 1,284 criminal suspects; more than 28,000 inflammable and explosive items were seized. 985 pieces (hands) of knives, firearms and ammunition and police equipment are controlled.

The average daily passenger flow of the subway in the province has also been showing a rapid growth trend. Especially during major holidays and during the morning and evening rush hours, the passenger flow gathers together in a short period of time.

Xia Zhengfang, deputy director of the Legislative Affairs Committee of the Standing Committee of the Provincial People's Congress, told reporters that the current national and provincial levels of special laws and regulations regulating the field of public transport security management are relatively lacking, only in the Public Security Management Punishment Law, Internal Security Regulations and other laws and regulations There are scattered regulations, which are far from meeting the actual management needs. It is very urgent and very important to further strengthen the defense line of the public transport security management system through provincial-level legislation.

  Special provisions for online car-hailing

The provincial public transportation public security management regulations have a relatively small legislative cut, and regulate the transportation methods that use public transportation such as buses, trams, urban rail transit, and taxis to provide travel services for the public.

Chen Yufeng said that, in particular, the inclusion of second-level and above bus passenger stations, taxis, and line passenger vehicles into the applicable objects and scope broke through the definition and division of the traditional public transportation industry and filled the gap in the public transportation security management in our province.

This legislation focuses on ensuring public safety and protecting the legitimate rights and interests of passengers, public transport operators and their employees, as well as their personal and property rights, and clarifies the responsibilities of all types of public transport participants.

Among them, the most striking is the responsibility that public transport operators should bear.

This Regulation integrates and refines the background review, security inspection and other obligations scattered in the Anti-Terrorism Law, Internal Security Regulations and other laws and regulations. A special chapter stipulates the operator's public security prevention obligations, and defines the operator's public security management obligations during operation.

The legislation focuses on the public security management of new business formats, and has made special provisions for online car-hailing.

"The regulations set clear requirements for online car-hailing operators, in particular, online car-hailing operators should implement security risk warning, real-time monitoring, tracking and judgment, and active handling of orders connected to the platform and abnormal situations found, and those who fail to perform safety The risk warning further clarifies the legal responsibility." Xia Zhengfang said.

The legislation also emphasizes that operators should pay attention to the physical and mental health of employees in important positions, and actively prevent accidents and extreme cases.

"There is no lack of precedents for major accidents caused by physical and mental abnormalities of drivers and passengers, and the consequences and impacts are often serious and bad." Xia Zhengfang introduced that in response to this problem, the regulations stipulate that public operators should conduct regular physical examinations for personnel in important positions, Psychological counseling, once it is found that the physical and psychological conditions are not suitable for working in important positions, the work position should be adjusted in time.

Stopping behaviors that impede safe driving can be considered courageous

The regulations enumerate and prohibit behaviors that may violate public security management, such as disrupting public order, hindering public safety, hindering social management, and infringing on personal rights and property rights.

Among these prohibited behaviors, in addition to the common not to carry or carry dangerous items in luggage on public transportation, it also includes not to seize or occupy the special seat for the elderly, the young, the sick, the disabled and the pregnant, and not to grab the steering wheel during public transportation. , gear lever and other driving control devices, shall not beat, pull, abuse the driver, etc., and according to the deliberation opinions, the prohibition of sexual harassment, indecency, theft or candid photography, peeping other people's privacy and other illegal acts are included.

Chen Yufeng introduced that the regulations also encourage passengers to discourage and stop ongoing behaviors such as obstructing safe driving and sexual harassment.

"For those who meet the conditions of being a righteous and courageous person, the public security organ will confirm it in accordance with the law, protect the legitimate rights and interests, and promote the positive energy of the society."

It is worth noting that the regulations clarify the obligation of public transport operators to strictly protect operational data.

Chen Yufeng said that public transport operators have gathered a large amount of static and dynamic basic data such as passenger personal information, travel information and vehicle trajectories during the operation process.

In recent years, after major vicious cases such as rape, robbery, homicide or passenger jumping to death have occurred in some places outside the province, which have caused great social impact in the country, some public transport operators are providing vehicle trajectories to the public security organs, Personnel information and other data are not fast enough and timely, which has caused certain obstacles to cracking down on crimes in accordance with the law and protecting the life and property safety of public transport participants.

In response to these new situations and new problems, the regulations also responded, stipulating that public transport operators should not only open data to public security organs and other regulatory authorities and cooperate with their work, but also strictly implement data security protection responsibilities, and must not illegally collect, use, or disclose personal data. information.

These requirements are all linked with the newly promulgated "Data Security Law of the People's Republic of China".
