Complaints are mounting after the drama that claimed the life of Halyna Hutchins on the set of
Rust
, but the producers, including Alec Baldwin, have every intention of fighting back.
The set's script, Mamie Mitchell, who is represented by attorney Gloria Allred, is the second cast member to take the case to court, a claim production officials say is inadmissible.
“Nothing in the plaintiff's allegations suggests that any of the defendants, including Mr. Baldwin, intended the gun to be loaded with live ammunition (…).
Because plaintiff's three causes of action are based on allegations of negligence resulting in a worker's injury, they must be dismissed because her exclusive remedy is based on New Mexico workers' compensation law, not on a civil action filed in California state court,” attorneys for the defendants responded in court, according to Deadline.
Russian roulette
According to the script, Alec Baldwin was playing "Russian roulette" with the gun on set when the gun discharged, injuring director Joel Souza and killing cinematographer Halyna Hutchins.
“Mr. Baldwin deliberately chose to play Russian roulette with a loaded gun without checking it himself or having it checked by the armourer.
(…) He had no right to rely on the simple declaration of the assistant director telling him that it was a cold weapon.
He can't hide behind the assistant director to apologize for not checking the gun himself,” the scripter said in her complaint.
Alec Baldwin denied being responsible for the drama in an interview with
Good Morning America
.
The police investigation is still ongoing.
