Interviewed on the premises of his ministry, Gérald Darmanin therefore affirmed on January 23 that he had taken “measures which mean […] that we can have this site closed and penalize the people who will continue to keep it alive”.

An announcement relayed on his Twitter account and accompanied by this message: "Under the law confirming respect for the principles of the Republic, I have launched the adversarial procedure prior to the closure of the website" The right path "".

  • What does this procedure consist of?

Used several times during this five-year term, the dissolution procedure can target associations or “groups of facts”.

In this specific case, it is aimed at the organizers of the “La Voie Droite” website.

Framed by the internal security code, this possibility of dissolution has, as the minister points out, been modified by the law on “separatism” promulgated last summer.

The grounds for initiating this procedure have been broadened and can now apply in the event of incitement to discrimination, hatred or violence on the basis of origin, sex, sexual orientation or race. gender identity.

  • Is dissolution synonymous with closing the website?

This is where things get complicated.

When Gérald Darmanin indicates that in the event of dissolution, criminal proceedings may be initiated against the people who will continue to bring the site to life, he is right.

If the procedure is successful, the “La Voie Droite” site will therefore remain frozen and can no longer be fed under penalty of prosecution.

But contrary to the assertions of Gérald Darmanin, this measure will not result in the blocking of the website.

In France, to block a digital platform and prevent Internet users from accessing it, the intervention of a judge or an administrative blocking measure is necessary.

Very supervised, these procedures oblige Internet service providers (ISPs) to cut off access to a site.

And blocking does not mean permanent deletion.

Indeed, only the host of a platform is able to do so.

However, as is the case in cases targeting contentious sites, the "La Voie droite" site is hosted in the United States by the Californian company CloudFlare, which has also been accused in the past of a certain complacency towards regard to terrorist organizations.

Finally, in this case, the channels used by "The Right Way" are multiple.

Beyond the offending site, a mobile application offering the same content deemed "hateful" and "Salafist" by the Minister of the Interior was still available on iOS and Android on Tuesday.

A channel on encrypted Telegram messaging is also accessible and has more than 7,000 subscribers, as well as a YouTube channel and a Twitter account.
