  Jiang Qiulian has at least 9 more cases in the process of litigation

  On the morning of January 12, Jiang Qiulian appeared at the gate of the Beijing Internet Court.

  This is her second visit to Beijing recently. At the end of 2021, Jiang Qiulian stayed in Beijing for 16 days in a row in order to promote the verdict of the dispute over the right to life with Liu Xin, and went to the relevant departments to express her appeal every day.

  Now that she is back in Beijing, she is in a much better mood.

On January 10, she got the first-instance judgment of the Qingdao Chengyang District People's Court: the court found that Liu Xin's behavior was at fault, and it also found that Jiang Ge's good behavior.

At a media symposium on the 11th, Jiang Qiulian said that she "told Jiang Ge" of the verdict and told her that "mother did it."

  But Jiang Qiulian couldn't stop. On the 12th, she came to the Beijing Internet Court again.

Jiang Qiulian told The Paper that there are many civil lawsuits she has filed here, all of whom she believes have publicly insulted and slandered Jiang Ge on the Internet.

"Some (cases) have been more than 2 years old, and no verdict has been pronounced." The purpose of this trip is to communicate with the judge about the situation of several cases, and hope that there will be an early result.

  Zeng Ming, the lawyer responsible for helping Jiang Qiulian handle the above-mentioned cases, told The Paper that there are currently 5 civil lawsuits brought by Jiang Qiulian in the Beijing Internet Court.

They sued netizens "Cold Eyes Meng Shu", netizens "special investigators", netizens "free writers", netizens "I am Zhao Zhao" on the grounds of Internet infringement, and Jiang Qiulian sued the Weibo platform.

The first three of these cases have all completed the trial, and one has not yet been heard. "The other party has the willingness to mediate and is still communicating."

  As for Jiang Qiulian's lawsuit against the Weibo platform, the purpose is to allow Weibo to disclose the registration information of more than a dozen Weibo users who have made inappropriate remarks.

Zeng Ming introduced to The Paper that in the communication with relevant persons of the Beijing Internet Court on the 12th, he mainly communicated the details of the above-mentioned cases.

"Our appeal is to ask the other party to stop the infringement, apologize, and compensate for the losses."

  These lawsuits cost Jiang Qiulian a lot of energy.

  At the same time, Jiang Qiulian also filed a criminal private prosecution against netizen Lin in Jianou, Fujian. Zeng Ming told The Paper that he had negotiated with the Jian'ou Court on the jurisdiction of this case before, and the negotiation has been completed, and he will urge the court to open the court as soon as possible.

  A defendant was sentenced to a year and a half

  Peng Mei News has learned that Jiang Qiulian had previously conducted a criminal private prosecution against the two for insults and defamation.

  Previously, a netizen named Tan published a series of articles and cartoons related to the Jiang Ge case through his Sina Weibo account "Posh-Bin".

Jiang Qiulian believed that the above cartoons and articles constituted insults and slander to Jiang Ge and himself, so he filed a complaint with the Shanghai Putuo Court against Tan for insulting and slandering.

  Shanghai Putuo Court sentenced Tan to one year in prison for insult and nine months for defamation, and decided to execute one year and six months in prison, and both sides appealed, October 2020, Shanghai No. 2 Intermediate People The court upheld the original judgment.

  Zhang Zheng, vice president of the Shanghai No. 2 Intermediate People's Court, once said that the article (defamed by Tan) has been viewed more than 420,000 times on the Internet and caused Jiang Qiulian's post-traumatic depression.

The judgment of this case shows that the Internet is not a place outside the law, and it also plays a certain role in the regulation of cyber violence.

  The creator of the insulting comics released by Tan was Zhang Mouning, a young woman in Anhui. Jiang Qiulian also filed a private criminal prosecution against her. Zeng Ming told The Paper that the case had been switched between private criminal prosecution and public prosecution many times. Close the case with an indictment.

  The prosecuting authority for this case is the Tianjia'an District People's Procuratorate.

The first-instance judgment made by the Tianjia'an District People's Court in Huainan City, Anhui Province in March 2021 showed that after the trial, it was found that on November 3, 2016, the victim Jiang Qiulian's daughter Jiang Ge was killed in Japan.

Jiang Qiulian posted on Weibo on August 15, 2017, "Seeking the Masses' Signature Activity to Sentence the Killer to Death".

Defendant Zhang Mouning saw the information on the Internet. In order to vent his personal emotions, he drew cartoons that insulted and satirized Jiang Qiulian and his daughter, and successively used "Ulanara Qiulian" and "Yehnara Qiulian". A number of Weibo accounts with nicknames posted the comics to the Internet. The Weibo accounts published through the "Yehnara Qiulian" Weibo account have been forwarded more than 1,500 times, clicked and browsed more than 10 million times, and given The victim's life has caused a bad impact, and it also confuses the public, seriously disrupting public order, and causing bad social impact.

  The court held that Zhang Mouning used the information network to abuse others, the circumstances were vile and disrupted social order, and his behavior constituted the crime of picking quarrels and provoking trouble.

In this case, Jiang Ge was innocently murdered abroad, his mother Jiang Qiulian lost her daughter in middle age, and the defendant Zhang Mouning did not know Jiang Qiulian’s mother and daughter. Moreover, the cartoons he draws are unsightly and his words are vicious. They have been forwarded more than 1,500 times on the Internet by others, and have been clicked and viewed more than 10 million times. The plot is vile and disrupts the social order.

His behavior violated both national law and human feelings.

The Tianjia'an District People's Court found Zhang Mouning guilty of picking quarrels and provoking trouble in the first instance and sentenced him to one year in prison.

Subsequently, Zhang Mouning's appeal was rejected by the Huainan Intermediate People's Court and the first-instance judgment was upheld.

  "There will be a fourth criminal private prosecution in the future, and it is uncertain whether there will be a fifth." Jiang Qiulian told The Paper that she wanted to "find out all those who insulted and slandered Jiang Ge."
