• This Tuesday, the investigative chamber of the Toulouse Court of Appeal examines a new request for the release of Cédric Jubillar.

  • In recent days, elements of the investigation have revealed that the duvet, presented as a key element in the guilt of Cédric Jubillar, had not been placed and washed by the husband on the morning of his wife's disappearance.

  • One of the serious and concordant clues for the accusation which falls into the water according to the defense.

Remains that the behavior and suspicious statements of Cédric Jubillar also forged the conviction of the investigators.

This Tuesday, the investigative chamber of the Toulouse Court of Appeal once again examines the request for the release of Cédric Jubillar, indicted since June 18 for the murder of his wife, Delphine. A new hearing during which the lawyers of this Tarn plasterer will not fail to address the new twists and turns concerning the elements presented almost seven months ago as being a charge against their client.

In particular the famous duvet that the young woman used to sleep on the sofa bed in the living room, the couple was in the process of separation. During his press conference on June 18, the public prosecutor of Toulouse at the time, Dominique Alzéari, indicated that it was in the washing machine when the gendarmes arrived in Cagnac-les-Mines, at 4:50 am, less than an hour after the report of the disappearance of the nurse by her husband.

“When the gendarmes arrive, they find Mr. Jubillar busy setting off a washing machine that has the duvet on the bed that Ms. Jubillar was sleeping on.

An incongruous context, it is not the first thing on which one thinks, had then affirmed the chief of the parquet floor.

A behavior which had something to cast suspicion on Cédric Jubillar.

Except that the famous duvet was not in the washing machine at 4:50 am.

A photo proves the presence of the duvet on the sofa

A photo taken by the gendarmes in the afternoon of December 16, during the first search, indeed shows that she is still on the sofa. “It was not found in the machine until December 17 at 3:10 pm, or 34 hours later. We had this December 16 photo on file, but it was of poor quality and we only saw a white clump. We never imagined that it was the duvet since we were told that it was in the washing machine, ”explains Emmanuelle Franck, one of Cédric Jubillar's three lawyers who claims his innocence.

It was during the questioning of her client, on December 3, that she had confirmation from one of the two investigating judges that the duvet was not in the machine on December 16 in the early morning. .

Cédric Jubillar always indicated that he did not remember if it was he who had placed it there that morning, or his mother later, the dogs having urinated on it.

A quilt which left more than a year ago in the scientific laboratory and whose analyzes are still not known.

Unlike those of the water from the washing machine which gave nothing.

Cédric Jubillar's lawyers are even wondering if she has not been lost.

More steps on the pedometer

Beyond the duvet, the thesis of Cédric Jubillar not moving to search for his wife in the house before the arrival of the gendarmes also has lead in the wing. The prosecution had indicated that he had only taken about forty steps, recorded on the pedometer of his mobile, between the time he turned it back on around 3:50 a.m. and the arrival of the soldiers an hour later. “In reality he did 46 between 3.50 and 4 hours, then 255 between 4 and 5 hours, or the equivalent of 200 meters. This argument no longer exists ", argues Emmanuelle Franck who had during a previous hearing dismantled point by point the" serious and concordant clues "which made Cédric Jubillar the suspect number 1 in the disappearance and murder of his wife.

According to a timestamp produced by her lawyers, the cries heard by a neighbor would not stick, Delphine having sent an SMS later to her lover, with whom she wanted to start a new life.

The mist in the nurse's car, which her husband could have used to make her body disappear, remains questionable according to her defenders.

There remains the direction of parking the car, reversed in relation to the habits of the mother of the family.

Or the statements of little Louis, who during his last hearing indicated that he would have heard his parents arguing, while on December 16, 2020 he had told the gendarmes the opposite.

Suspicious behavior and statements

But what confirms the thesis of the murderous husband is above all his behavior and the statements he made, before and after the disappearance of his wife.

Elements which are far from pleading in his favor and which forged the conviction of the investigators.

Before the night of December 15-16, he told several people, including his mother, that he was going to "kill her, bury her" and that she would not be found.

In the months following his disappearance, he was said to have joked on the subject as well.

And after his indictment and imprisonment, he allegedly confessed to a fellow inmate that he killed his wife with a knife and buried her on a farm which has since burned down.

These are the statements of this man which led last December to the custody of Séverine, the current companion of Cédric Jubillar.

There is also a context, that of a couple in full separation.

A few days before December 15, Delphine planned with her lover in her future relationship, consulted a lawyer specializing in divorce.

And on the morning of December 15, she went to the bank to change her secret bank card code and block access to children's passbooks on which Cédric Jubillar regularly drew.

"Other avenues have not been explored", according to his lawyers

"The arguments which consist in saying that he is not nice, that they are going through a divorce, that he is ironic and provocative, that is not justice.

What would that mean, that if he had another personality he would be free?

“Asks Emmanuelle Franck.

An argument that with masters Alexandre Martin and Jean-Baptiste Alary, she will not fail to put forward on Tuesday.

While pointing out that “other avenues have not been explored”.

In the meantime, this Saturday, the brothers and sister of Delphine Jubillar, civil parties in this case but who remain discreet in the media, have a mass of meditation given in the Cathedral of Sainte Cécile d'Albi at 4 p.m., in memory of Delphine Jubillar.

All of them yearn to know the truth about what happened to their sister on the night of December 15-16, 2020.
