Man was sentenced to seven years in prison for selling drug-containing "top electronic cigarettes" through express delivery

  On December 8, a new drug crime case prosecuted by the People's Procuratorate of Jing'an District, Shanghai, was sentenced.

  According to the prosecutor's office, starting from July 2021, Song has repeatedly sold "top e-cigarettes" to others through courier, flash delivery, etc. The e-cigarettes contained "synthetic cannabinoids".

Synthetic cannabinoids are synthetic chemical substances that can produce more intense excitement, hallucinations and other effects. They have been included in the "Additional List of Non-medicinal Narcotics and Psychotropic Drugs Controlled Varieties" by my country.

  In August, the police seized 5 bottles of colorless and transparent liquids at Song’s temporary residence. After identification, the above 5 bottles of colorless and transparent liquids totaled 28.89 grams, all of which were detected as cannabinoid substances ADB-BUTINACA.

  According to Song's confession, the colorless and transparent liquid is the "top e-cigarette" e-liquid, which he has directly sold or filled in e-cigarettes to sell to others on many occasions.

  The prosecutors found that Mr. Song had sold 28.89 grams of synthetic cannabinoid substance ADB-BUTINACA. His behavior had violated the criminal law and he should be held criminally responsible for the crime of drug trafficking.

On November 25, the Jing'an District Procuratorate filed a public prosecution against Song.

  On December 8, the Jing'an District Court opened a court session to hear the case.

In court, Song confessed to the crime and voluntarily pleaded guilty and punished.

The court sentenced Song to a fixed-term imprisonment of seven years and fined him 7,000 yuan.

  According to Zhang Zhongping, Director of the Second Prosecution Department of the Jing'an District Procuratorate, starting from July 1, 2021, China will formally list synthetic cannabinoids and other new psychoactive substances. The cannabinoid substance ADB-BUTINACA involved in the case belongs to China. Drugs in the legal sense.

The sale of "shangtou e-cigarettes" containing this type of synthetic cannabinoids is considered drug trafficking, and smoking "shangtou electronic cigarettes" is considered drug use.

  In this case, Song sold e-liquid and e-cigarettes containing "synthetic cannabinoids" through express delivery, flash delivery, etc. The transaction involved the Internet, delivery, and cross-regional trafficking, and the transaction form was concealed.

In recent years, the Jing'an District Procuratorate found that in the process of new drug transactions, both parties often contacted via WeChat or phone in advance, and then delivered drugs by express or flash delivery.

  On October 20, the Supreme People's Procuratorate issued the "No. 7 Prosecutorial Recommendations" aimed at strengthening the safety supervision of delivery and advancing the governance of delivery safety issues.

  The Jing'an District Procuratorate stated that it will further investigate the supervision and management of drug crimes in the delivery industry involved in the case, promote the implementation of delivery security systems such as receipt inspection, real-name receipt and delivery, and continue to purify the delivery safety environment.
