A Syrian judge revealed that males have more complaints than females in cases of marital infidelity, pointing to the legal framework and provisions for these cases.

Judge Tariq Al-Kurdi told the Syrian newspaper, Al-Watan, that “the complaints of males are more than the complaints of females in the two judges of infidelity,” suggesting that this is due to “the possibility of the woman not knowing that she has the right to file a lawsuit against her husband in the event that he takes a concubine openly or practices it.” With her he committed adultery.”

Al-Kurdi explained that "Syrian law allows a woman to file a lawsuit before the Court of First Instance for treason, whether by publicly taking a woman as a concubine or engaging in adultery with her in the marital home."

Al-Kurdi explained that “such cases are difficult to prove, given that such relationships are not easily proven,” noting that “marital infidelity can be proven by testimony or exchanged messages between the husband and the woman who took him as a concubine or by his approval, and that it is just that he speaks out. The husband in his relationship with that woman is considered marital infidelity, and therefore the woman has the right to claim this betrayal.”

And the Syrian judge stated that “the law was keen on the wife’s feeling and giving reassurance to marital life, because the wife could take actions that could harm the husband if she knew of his infidelity to her, and that from this point of view the law took into account the feelings of the wife and considered the husband’s openness of infidelity as a crime punishable by law. “Proving the act of adultery committed by the husband with his partner is difficult, given that this act is not done openly, and this requires witnesses to confirm that he committed this act as he does with his wife.”

The Syrian judge revealed that “the husband cannot file an adultery lawsuit against his wife and her partner three months after he learned about adultery, and that the wife does not lose her right to file a treason lawsuit against her husband until after three years, which is the limitation period for misdemeanor crimes.”
