Opposed to the wearing of masks imposed on students from CP to CM2, a measure that has made a comeback all over France since the beginning of November, they decided to attack the French state for "violation of the rights to health and education of children in elementary school ”, indicates Me Claire Murillo, lawyer from Le Mans from the Sarthe group of Parents atterrés, at the origin of the process.

Convinced of "the physical and psychological impacts, and on access to education" of wearing a prolonged mask, ten hours a day for some children, these families, who had been rejected in June by the Council of 'State, do not disarm.

"We present a substantiated argument, with studies, testimonies, positions of health professionals", indicates Nicolas Landy, coordinator of the collective.

These parents, who indicate "no longer have confidence in the institutions", regret the fact that no study on the "real benefits" of the measure, which entered into force more than a year ago, has been carried out by the state.

They, in any case, are convinced: "We say that hiding children has no impact on the epidemic, on the other hand there is a risk for the children, with for some of the respiratory problems, a distress on the psychological level, an inability to perceive the emotions of their comrades or their teachers… ”, continues Nicolas Landy, who recalls that the president of the French Pediatric Society recently qualified the measure as“ nonsense ”.

A few months ago, another group of parents from Pays-de-la-Loire, in the Angevin region, had already seized the European Court of Human Rights, for the same reasons.

“Their request was recently deemed admissible, that is to say that they have passed into the investigation phase, welcomes Nicolas Landy.

We believe that the ECHR will join our two files.

His answer is in any case not expected for several months.
