During the National Day holiday this year, Qin Ya, who lives in Changping District, Beijing, traveled by car with her friends.

When queuing up on the highway on the outskirts of Beijing, because the speed of the car was a little slower, a car on the right suddenly speeded up and blocked.

Qin Ya was on fire immediately.

She banged the horn several times "Papa Papa", then picked up the phone, and muttered in her mouth while taking pictures of the other party's license plate: "I'm so in a hurry, I want to reincarnate in a hurry. I want to expose you and let you add stuff!"

Immediately afterwards, she chased down and lowered the window and shouted at the car: "What did you add? Did you give the signal in advance? Will you pay if you hit the car?" The passenger in the car in front turned his head from the window, disdain Possessing his mouth and rolling his eyes.

This made Qin Ya even more angry. If her friends hadn't been in the car to persuade her to forget, she even had the urge to "fight with him on the accelerator" at the time.

Afterwards, a friend told Qin Ya that she was shocked at the time, and she didn't think that she had a particularly good temper because she was stuffed, and she seemed to have changed.

For this, Qin Ya also felt a little ashamed: "I don't know what's wrong. When I drive, small things can become big things, and I can't control my emotions."

Like Qin Ya, there are not a few drivers who are trapped by "road rage".

The Institute of Psychology of the Chinese Academy of Sciences once randomly selected 900 drivers in 3 cities of Beijing, Shanghai, and Guangzhou to conduct a questionnaire survey. About 35% of the drivers admitted that they belonged to the "Lunu ethnic group."

"Road rage" usually refers to anger caused by traffic jams while driving or because they do not understand the driving behavior of other drivers.

Under such emotions, the author may make random changes in lanes, forcibly overtake, run amber lights, swear words, and other behaviors. In severe cases, they may even attack other vehicles or drivers.

Experts interviewed by a reporter from the "Rule of Law" believe that "road rage" appears to be a psychological problem, behind which is not only the driver's control of personal emotions, but also may be affected by the pace of life, road conditions and other conditions. The psychological nature is still indifference to traffic civilization.

To alleviate the problem of "road rage", the focus is to improve the driver's personal awareness of traffic civilization and awareness of rules.

Easy to get angry when encountering Gasser

Disregarding the rules leads to disputes

He honked his horn because the vehicle in front was too slow, and screamed in the driver's seat because the vehicle in front suddenly changed lanes... Qin Ya never expected that he would suffer from "road rage."

You know, she usually speaks softly when chatting with people, and friends around her commented on her character as "very gentle".

In fact, it took only three months for the 25-year-old Qin Ya from the first time he drove on the road to becoming a "road rage" driver.

Qin Ya recalled that her symptoms of "road rage" can be divided into three stages: in the first stage, she just sits in the driver's seat and silently complains; in the second stage, she starts to sound the horn to warn the vehicle ahead and crossing that affect her acceleration. Pedestrians on the road; the third stage has evolved into two "theory" sentences for the driver who will accelerate with one kick of the accelerator to overtake the car in front, occasionally lower the window and change lanes suddenly.

Realizing that she tends to lose control of her emotions while driving, Qin Ya often reflects on it, but when driving a driver with bad road conditions or uncivilized driving, she is still prone to irritability and anger.

Like Qin Ya, Hong Lin from Quanzhou City, Fujian Province is kind to others and rarely loses his temper. But after driving on the road, his temper becomes very irritable.

Sometimes when I see those vehicles with high beams on city roads, my temper comes up, and I can't help but mumble, "There are street lights on both sides, is it blind?"

What Hong Lin couldn't stand the most was the situation of other vehicles being blocked.

At first, Hong Lin would slow down and avoid because he was afraid of rubbing against the other party. The more times, Hong Lin felt that he was at a loss. "The other party didn't appreciate it when he avoided the opponent, but instead encouraged this behavior."

So when someone else rushed into a stop, Hong Lin neither gave way nor gave way, but directly accelerated. If the other party honked the horn or lowered the car window to express dissatisfaction, Hong Lin would also shake the head of the car window to fight back.

The reporter combed and found that as the number of vehicles in the city continues to increase, there are more and more emotional conflicts caused by driving.

Previously, statistics released by local public security traffic control departments showed that there are many reasons for "road rage".

22.9% of drivers were angry because novice drivers did not understand the rules; 48.1% of drivers were angry because of traffic jams and poor road conditions; 26.6% of drivers were angry even if they did not affect their traffic because of other traffic violations; 29.7% of drivers were angry when the vehicle was congested or overtaken.

According to Zheng Xiang, associate professor of Law School of Beijing Jiaotong University and vice president of Beijing Transportation Law Research Association, "road rage" is a kind of psychological problem. Fantasy symptoms, but its psychological nature is still indifference to traffic civilization.

"From a social perspective, the accelerated pace of modern life has led to increased pressure on people. People are more willing to'instant gratification' and unwilling to delay. The strong desire to reach the end makes people unable to enjoy the fun of driving and the ease on the way. Any delay The factors that reach the end point have all become obstacles in the eyes of the driver, making it easy to get angry." Zheng Xiang said.

The lesson behind "Road Rage" is painful

Life and property may be damaged

In recent years, traffic accidents caused by "road rage" are not uncommon.

The data shows that from January 2012 to the end of April 2015, the national public security traffic control departments investigated and dealt with forcibly changing lanes, forcibly overtaking, illegally rushing, forcibly occupying the road, and not giving way according to regulations, and other “road rage” violations totaling 104 million rise.

According to official data from the Ministry of Public Security, 80,200 accidents were caused in 2013, a year-on-year increase of 4.9%.

In 2014, it increased by 2.4%. This figure increased by 1.7% from January to April 2015.

Behind these data may be one painful tragedy after another.

On August 5, 2021, a malicious car driving case occurred at a distance of 1411km from the north to the south of the Hunan Yueyang section of the G4 Beijing-Hong Kong-Macao Expressway.

The driver Song suspected that the vehicle behind him wanted to overtake, but he was too angry to stop the vehicle behind him, causing 3 vehicles to rear-end and 2 people died on the spot.

On October 3, 2021, a traffic accident occurred on the Hengfeng section of the Shanghai-Kunming Expressway in Jiangxi.

The driver Li was driving in a slow lane at a speed of 110km/h. When he was less than 20 meters away from a large truck in front, he suddenly accelerated to overtake. As a result, he struck a black car in the left lane when he crossed to the left and changed lanes. Two cars overturned, and Li's wife died of a violent collision.

Dai Qian, who lives in Xicheng District, Beijing, was deeply afraid of these public traffic accidents caused by "road rage."

She didn't expect that she would also encounter this "emotional killer", and she was fortunate to have escaped.

In mid-April this year, Dai Qian went on a business trip out of town. One hour before the departure of the train, he used the taxi software to call an express train to the station.

After driving for a while, a sudden impact and a sudden brake drove Dai Qian to the front, hitting her face on the front seat of the car, and the earphone cable was pulled off.

With sore nose and golden stars in her eyes, Dai Qian took a long time to get over.

It turned out that the driver of the vehicle in which Dai Qian was riding saw that the vehicle on the other side of the lane was moving faster, which was the speed of the map. Without turning on the turn signal and decelerating, he directly turned the steering wheel to change lanes.

After seeing the stoppage of the vehicle, the rear vehicle tried to pass the accelerator with a kick, so the two vehicles collided.

At this time, not only was the express driver unable to continue sending Dai Qian, but the collision between the two vehicles also caused traffic congestion on the road.

In a hurry, Dai Qian got off the car and stopped another taxi on the side of the road. Finally, she missed the starting point of the train.

Later, she reported the situation to the taxi-hailing software customer service. The customer service responded that the express driver was fined by the traffic control department, and the platform also refunded the fare paid by Dai Qian.

Penalties based on the consequences

Punishment and detention

What penalties should be imposed on traffic accidents caused by "road rage", and on what basis?

Wei Zhensheng, deputy director of the Traffic Management and Transportation Law Professional Committee of the Beijing Lawyers Association and lawyer of Beijing Yingke Law Firm, said that "road rage" does not have a clear definition and concept in law.

What legal provisions may be involved in the "road rage" behavior depends on the consequences of the behavior.

The reporter checked the publicized cases in various places and found that the punishment for "road rage" was fine and deducted points, and the punishment was criminal detention.

One day in August this year, on the Tanshan overpass section of Xialu District, Huangshi City, Hubei Province, when the driver Lu Mou was driving normally, a car suddenly turned right from the side road and drove out, causing the two cars to almost rear-end.

Lv was dissatisfied, deliberately overtaking to the front of the opponent's vehicle, repeatedly stopped the opponent's vehicle, and made insulting actions at the opponent's vehicle.

Lu was fined 200 yuan and deducted 2 points for obstructing safe driving while driving.

On the evening of October 11, on a road in Binjiang District, Changshu City, Jiangsu Province, the driver Ma was forced to stop maliciously by another vehicle driver when he was driving normally.

The reason is that when Zhu drove from the side road to the main road, Ma drove the vehicle straight without being courteous, and Zhu became angry and made a forced stop behavior.

In the end, Zhu was detained under criminal detention on suspicion of provoking troubles.

On the morning of November 3, when driving a car on the Xiangtan section of the Beijing-Hong Kong-Macao Expressway in Hunan, the driver Yu Mou drove a car to overtake. Parked in the overtaking lane, causing the bus co-driver Lin to beat Yu.

In the end, Lin was fined 500 yuan as an administrative penalty for deliberately assaulting others, while Yu was detained under criminal detention on suspicion of endangering public safety in dangerous ways.

Regarding the varying degrees of punishment that may be incurred by "road rage," Wei Zhensheng said that if drivers forcibly overtake, merge, and keep honking their horns, these actions violate the Road Traffic Safety Law.

In accordance with the requirements of the corresponding provisions, administrative penalties such as fines and deductions shall be imposed.

The second law that may be violated is the Public Security Administration Punishment Law.

Wei Zhensheng said that the "road rage" has escalated, and the vehicles on both sides have been scratched, or the cars have hit a pedestrian, or the two sides have a slight physical conflict after getting off the car. This situation will violate the law on public security management and punishment, and may be fined and warned. Or administrative detention.

"Seriously, it may violate the criminal law." Wei Zhensheng pointed out that if the two vehicles set off each other and chase each other at a high speed, this behavior and drunk driving are a crime-dangerous driving crime.

And if the physical conflict that occurs after the identification reaches the standard of minor injuries or above, it may constitute the crime of intentional injury; if the dispute between the two parties seriously affects the traffic in a public place, it may also constitute the crime of quarreling and provoking trouble.

"In the practice of punishment,'road rage' is not a condition of mitigating punishment. If it is not accompanied by drug abuse, drunk driving, etc., it is not a condition of aggravating the punishment. In other words, whether the simple'road rage' constitutes a mental disorder, Whether to reduce or increase its legal liability, there are no relevant provisions in the laws of our country, and it will not be used as a reference for law enforcement." Zheng Xiang said.

Strengthen psychological adjustment education

Improve the awareness of traffic civilization

Because "road rage" is a manifestation of emotional stimulation, experts believe that the most important thing for the management of "road rage" is that the driver must form a sense of traffic civilization and rules, and the outside world can use other methods such as education. Assist drivers in civilized and safe driving.

"For example, set up a theory test during the driver's license test, and add more'road rage' warning questions to the theory test, so that drivers can develop the awareness of preventing'road rage' from the start. It can also be in the community and on the road. Significant educational warning slogans have been set up on the site to subtly influence people’s perceptions.” Wei Zhensheng suggested.

Zhang Zhuting, a professor at the School of Management of the Ministry of Transport, pointed out that the treatment of "road anger syndrome" requires comprehensive measures: speed up traffic construction and completely solve the problem of traffic congestion physically; Take severe crackdown measures; strengthen the psychological adjustment and education of drivers, add some driving psychology education and training courses in the driver's license training link, and intervene from the early stage.

Zheng Xiang said that for the individual driver, if he encounters a deliberate blockage or leaves the car, but no traffic accident is caused, and there is no law enforcement officer on the road to punish him, he can use the driving recorder to record video and other evidence to the traffic management. Department report.

If it is a taxi driver or online taxi driver who suffers from "road rage," passengers can remind the driver to stabilize their emotions, or use the platform to report and let the platform impose penalties.

Zheng Xiang mentioned that the law stipulates that if one party intentionally causes a road traffic accident, the other party is not responsible.

Therefore, if the other party causes an accident due to "road rage," the person concerned must exercise restraint and not "use violence to control violence."

Otherwise, it was originally the injured party, but turned into the responsible party, and it needs to bear the corresponding legal responsibility.

It is worth noting that from the currently exposed cases of traffic accidents caused by "road rage", drivers such as buses, heavy vehicles, and hazardous chemical vehicles have fewer cases of "road rage".

In this regard, Zhang Zhuting proposed that buses, heavy vehicles, and hazardous chemical vehicles are commercial vehicles. The reason why such vehicles have fewer problems with "road rage" is related to the structure of the driver.

"Most of the drivers of such commercial vehicles are managed by units. The relevant state departments have successively put forward some policies and legal requirements for these commercial transportation positions. In recent years, they have paid more and more attention to the quality and quality of the drivers. Mental health. Units engaged in operational transportation business have also actively implemented relevant policies and carried out related education and training for employees. Now most units and trade unions in the industry will regularly visit homes to investigate the psychological status of drivers from the perspective of their families Understanding, thereby effectively regulating the emotional problems of drivers." Zhang Zhuting said, this has a certain reference and enlightenment for how to do a good job in the promotion of the rule of law into the work of the unit.
