Spain will have new regulations on copyright and opens the door to the return of Google News to our country.

Council of Ministers approved, with a five-month delay, the transposition of European regulations

This movement, after intense negotiations between the media, technology and the Ministry of Culture partially nullifies the AEDE canon.

Google will be able to negotiate remuneration with each communication medium

from which it indexes content on its platform.

A modification that, according to the European Commission's deadlines, should have occurred on June 7.

The Google news aggregator had ceased its activity in Spain in 2014 with the entry into force of the new Intellectual Property Law.

Specifically, the conflict was in article 32.2 of that regulation, which established the AEDE canon, which forced Google to pay obligatorily for linking and displaying any media content to the association of editors and authors Cedro.

During these last seven years, the negotiations between the parties have been continuous without reaching an agreement and leaving Spain as the first country in the world to close the Google News service. Finally, with the agreement in Brussels, and almost five months later than expected, the approval of the Council of Ministers of the European Union regulations opens the doors for his return in the absence of confirmation from the technology giant.

In his first appearance in the Congress of Deputies, on September 30, the current Minister of Culture, Miquel Iceta, pointed out that

this delay was due to "the pandemic" as had happened in "most European countries"

and that in October it would be approved. Finally, it will be in November when the approval is given to a regulation that its predecessor, José Manuel Rodríguez Uribes, indicated that it was being delayed due to the lack of general guidelines from the European Commission.

The new legislation approved opens, according to a statement from the Ministry of Culture, "a new related right for press publishers and authors" and guarantees "a right with its own entity,

owned by the publishers of press publications and news agencies

regarding to the online uses of its press publications, vis-à-vis information society service providers ".

For this reason, in his presentation in the Congress of Deputies in the Culture Commission, the minister assured that coupled with the transposition of European regulations his department would carry out a regulation of the Spanish Copyright Office, but without fixing a specific date or the lines to follow in said project.
