• Odyssey Case Eternal Chronology

The Provincial Court of Cádiz has definitively and with "anger" filed the proceedings against the

treasure

hunter company Odyssey, author of the looting of the Spanish Navy frigate

Nuestra Señora de Las Mercedes

, from which they extracted a treasure valued at

500 million dollars

, for the delay of the US in completing a letter rogatory requested eight years ago.

In an order dated last July, to which Efe has had access, the Algeciras Section of the Provincial Court of Cádiz dismisses the appeal of the popular accusation of the case, exercised by Nerea Arqueología Subacuática, against the dismissal and filing of this court case, which started 14 years ago.

And thus he considers the last battle against the looting of the

Mercedes

as settled

, within a judicial war in which Spain managed to force justice to the Odyssey treasure hunter, from the United States, to return the treasure it

had secretly extracted

from the city. Spanish frigate, sunk in combat against the English fleet on October 5, 1804 in the Atlantic along with more than 250 sailors and Spanish citizens.

The perpetrators of the plunder

will not be tried because the proceedings against them for the crimes of damages and smuggling have been prescribed

thanks to the fact that the rogatory commission that the Spanish justice sent to the US to interrogate those investigated, requested in 2013, was never completed.

In the file order, against which

there is no recourse

, the Cádiz Court expresses that it shares with the appellants of the file "its strangeness, bewilderment and even anger at the, let's call it,

unusual processing of this case, at least since the year 2013

", when, after numerous investigative proceedings, the La Línea de La Concepción court that has instructed the case, asked the US for the rogatory commission.

But he agrees with the dismissal decreed in 2016 by this court, a decision that, before an appeal, he reconfirmed in September 2020.

The Hearing considers that

"it is not logical" to

continue with the judicial process because the crimes that were imputed had a limitation period of five years that has been more than exceeded.

"The truth is that since the rogatory commission was sent, more than five years have passed without a statement being taken from the investigated or any person, so that

their presumed criminal responsibility

for these events

should be

understood as extinguished

," the order adds.

In 2009 a judge in Tampa (Florida) ruled that the treasure extracted from the Spanish frigate, in which there were 17 tons of silver and gold coins, be returned to Spain.
