Reporter investigation丨The real-name system is in vain!

How to manage minor online games that bypass supervision?

Real-name systems are the same as virtual accounts and online rental and sales are still common

On Monday, the CCTV news channel of the main station reported on the real-name authentication loopholes in online games, the face recognition system can be "cracked", and the number rental platform has opportunities to be exploited.

On September 8, in response to related issues, the Central Propaganda Department, the National Press and Publication Administration, together with the Central Cyberspace Administration of China, the Ministry of Culture and Tourism and other departments conducted interviews with key online game companies, game account rental and sales platforms, and live broadcast platforms, and required relevant companies It is necessary to resolutely implement the relevant requirements and effectively protect the physical and mental health of minors.

How about the implementation of relevant companies and platforms?

Check the reporter's investigation.

In interviews, many parents generally report that there are still a large number of game companies that have too simple requirements for user registration and login, and lack of identity authentication measures such as biometric identification, making the real-name system useless.

Many children even rent or purchase adult accounts through online platforms to bypass anti-addiction supervision, causing headaches for parents.

Parents:

Our parents can only observe the children. Are you playing games at other times? I can only strengthen the management of the children. I can't do anything else.

Middle school students:

Just use the parent's mobile phone to play, or register with the parent's identity, and then if someone rents a number or something, they just go to play.

Regarding the problem of reselling and subletting game accounts, the reporter conducted an investigation on some of the networks and e-commerce platforms commonly used by people at present.

Enter the word "rental number" on the Baidu search engine, and the page displays a large number of inductive items such as "the cheapest rental number", "rental number platform without real-name authentication".

The reporter then opened multiple e-commerce platforms and found that there were also a large number of game account rental and sales merchants.

The price of the game rental number ranges from 1 yuan to several hundred yuan, and you can rent an account with a minimum of 1 yuan.

Some stores cover more than 50 different types of online games. Many sellers show that the monthly transaction volume of a single popular game rental account exceeds 2,000, and the monthly transaction volume exceeds 40,000.

On a second-hand trading platform, the reporter enters the "game rental number" and the detailed classification is in the "game channel" recommended by the platform. Not only can you see the "rental account starting at 1 yuan", there are also the so-called "power leveling orders to make money" and "buy accounts" Trade with confidence" and many other projects.

Many merchants stated in the item description that as long as the payment is successful, the account password will be automatically sent without time limit and other content.

In the game account classification set by another e-commerce platform, there is even a special "No Addicted Account" item.

The reporter found that online social platforms are even more "hardest hit areas" for account rentals and sales, and transactions are more concealed.

On the QQ software, although reporters directly searched for "buy account, rent account" and found no relevant information, some group administrators replaced "sell account" and "buy account" with homophonic characters to guide users to privately trade.

A rental account advertisement of a certain QQ group stated impressively that "seller package face recognition can be deleted" and other information that clearly induced minors to purchase.

In Baidu Tieba, reporters searched for "rental account, buy account", although it shows that "relevant results will not be shown", but there are still many posting bars under the name of game rental account and buy account, which are flooded with transaction information of a variety of popular online game accounts. Some users even name game accounts that "have been authenticated and do not need to face recognition again".

In Xiaohongshu, a reporter searched and found that there were also a large number of users posting posts about renting and selling game accounts.

Lack of supervision on the platform for easy rental and buying accounts for minors

The reporter found that multiple e-commerce platforms included the "game account transaction" service in the category of virtual products, reminding users that they must be 18 years old when trading virtual goods in online games, and submit identity information for real-name authentication. The platform will prohibit and intercept minors. Virtual goods transactions in online games.

So, are minors really unable to purchase game accounts?

The reporter used a 15-year-old child's real-name authentication account to try to buy game accounts on multiple e-commerce platforms.

On Taobao.com, minor blocking interfaces appeared on some business pages, but reporters still bought "number rental services" in more shops that did not set up minor blocking interfaces.

In Pinduoduo, you don’t need any certification, you can buy directly with the order.

In JD.com, the merchant only automatically replied to a message stating that the order was placed by default, and the reporter quickly received the game account and password after the order was placed.

Reports and complaints were made to relevant platforms for users and shops who rented and sold online game accounts in violation of the above-mentioned laws and regulations.

A few days later, the reporter logged on to the relevant platform again and found that on the JD platform, the game account products reported by the reporter all showed that they had been taken off the shelves, and searching for "game rental number, sales number" basically failed to find relevant information.

On Taobao.com, the reported account-rental products have been removed from the shelves, and the function of intercepting minor transactions has been strengthened, but account-rental shops still exist.

The goods reported on the Pinduoduo platform are still on sale, and the relevant goods can still be purchased regardless of whether the user is an adult or not.

Regarding the social media platform, QQ responded that “it is temporarily unable to determine that the reporting object has violations”. On platforms such as Baidu Tieba and Xiaohongshu, the customer service will only reply automatically within 24 hours or 2 to 3 days, as of the time of press , Did not receive a valid reply.

Peng Ling, deputy director of the Membership Department of the Chinese Law Society: In the

notice on further regulating management and preventing minors from online addiction, it clearly requires that the real-name registration and login requirements for online game user accounts must be strictly implemented. Users who log in with their real names provide game services.

So what we should note here is that it refers to users, not just minors.

In other words, it is illegal to provide game services to users who have not logged in with their real names.

Expert: Illegal game account rental and sale should be severely cracked down

Experts said that, regardless of whether the user is a minor or not, any act of providing users with a game account for rent and sale is illegal and relevant departments will severely crack down on it.

Article 24 of my country's "Cyber Security Law" stipulates that when a network operator signs an agreement with a user or confirms to provide services, if the user does not provide true identity information, the network operator shall not provide relevant services for him.

The reporter learned that the "Personal Information Protection Law" that will be implemented on October 1st stipulates that information including game account numbers, personal passwords, and verification codes are sensitive and private personal information and is protected by law.

Experts said that even if some e-commerce platforms state on the page that they do not provide online game account transaction services to minors, from a legal perspective, this is an invalid exemption and invalid defense.

Zhu Wei, deputy director of the Communication Law Research Center of China University of Political Science and Law:

These commercial behavior phenomena are themselves illegal, because even if an adult sells an account to an adult, it is an illegal act.

Because this involves the issue of personal information, the issue of real-name authentication of network behavior.

You register with the person of A and log in with the method B. Many telecommunications frauds are completed by logging in with fake accounts on the Internet.

All game platforms, including Internet platforms, which involve account issues, are clearly stipulated in the netizen agreement, and it is absolutely not allowed to transfer the lease in any way.

Therefore, this act violates both the civil law and the administrative law. It may even be a crime involved in the national "Criminal Law" if the account is sold in large quantities, which is a crime of infringing on citizens' personal information, so it is A very serious violation of the law.

A few days ago, the relevant persons in charge of the Central Propaganda Department and the National Press and Publication Administration, together with the Central Cyberspace Administration, the Ministry of Culture and Tourism and other departments, emphasized that relevant companies and platforms were talking about Tencent, NetEase and other key online game companies and game account rental and sales platforms. All requirements must be strictly implemented, and online game account rental and sales transaction services must not be provided to minors in any form.

Relevant departments will strengthen supervision, carry out special inspections, and deal with violations seriously.

Improving identity recognition to allow "real person" authentication to land

It is precisely because the existing online games do not fully implement identity identification when registering and logging in with real names, merchants can use this loophole to bypass the anti-addiction system and protect personal information, especially the protection of minors.

Therefore, in the final analysis, perfecting identity recognition is the key to the implementation of the game anti-addiction system.

Experts said that in the process of implementing user real-name authentication, game companies must correspond to people and behaviors, continuously upgrade technical means to authenticate and log in, prevent easy registration and login with other people’s identities, and eliminate the phenomenon of game account rental and sales. Responsibility for the protection of minors.

Huang Daoli, director of the Cyber Security Law Research Center of the Third Research Institute of the Ministry of Public Security: For

enterprises to have a right attitude, their real names must be implemented as "real people."

Otherwise, the real name is just a mere formality, for example, you want to add face recognition, or you want to add this kind of biometrics to ensure that the person and the name actually correspond.

Zhu Wei, deputy director of the Communication Law Research Center of China University of Political Science and Law: There

are many ways to log in for identity verification, and the cost is actually not high. The "Law on the Protection of Minors" has just been revised on June 1st this year, and it is particularly emphasized. The Internet platform must install a youth protection system, or parental monitoring system, to solve the problem of minors bypassing the monitoring system through a technology-to-technology method.

This is the main responsibility that the platform should fulfill, the most important one at the core.

Article 62 of the "Personal Information Protection Law" to be implemented on October 1 this year clearly requires relevant departments to research, develop and promote the application of safe and convenient electronic identity technology, and promote the construction of public services for network identity authentication.

Huang Daoli, director of the Cyber Security Law Research Center of the Third Research Institute of the Ministry of Public Security:

That is actually what our public security department wants to do. On the basis of the "Cyber Security Law", to build a national identity authentication public service.

This public platform is free, and companies can rely on this platform for certification.

In fact, this is for us to reduce the abuse and abuse of personal identity information from the source. In this case, we must move our real names to "real people", which is completely possible.

It is understood that relevant departments will launch a reporting platform to prevent minors from indulging in online games in the near future, and promptly accept and deal with clues about problems. For companies that fail to implement them, they will find strict measures to ensure that the anti-addiction work is implemented and effective.
