Jeju middle school student murder case, why couldn't it be stopped?

The SBS 'I want to know' broadcast on the 7th shed light on the Jeju middle school murder case and domestic violence crimes with the subtitle 'Intruders in the Attic - The Truth of the Jeju Middle School Student Murder Case'.

On July 18, 16-year-old Kim Kyung-hyeon from Jocheon-eup, Jeju was found dead in the attic of his house. His mother, returning home from work, later found the body of her son, and the shock was indescribable.

Police found traces of murder on Kim's body, and soon the murderer was arrested. The shocking incident decided to reveal their identities, and the culprits who brutally murdered a 16-year-old middle school student were Baek Kwang-seok and Kim Si-nam.

At the time of the initial discovery, Kyunghyeon had his hands and feet bound with tape and was strangled by something. The autopsy doctor explained, "The most fatal wound is the scar on the neck belt. The traces of drowsiness appeared on the neck, and it seems that it was the direct cause of death."

In particular, Baek Gwang-seok, who killed Kim, was even more shocked when it was revealed that he and Kyung-hyeon had a father-son relationship until two months ago due to a common-law relationship with his mother. This was also the case with Kyunghyeon's mother. Park Hye-eun (pseudonym) did not accept the death of her son, saying, "I do not understand why he killed him."

After 2 pm, Kyunghyeon, who was having a late lunch alone, talked to her mother on the phone and went up to the attic after eating. Kyunghyeon fell asleep with the window open in hot weather. And Baek Kwang-seok and Kim Si-nam waited for the window of the attic to open, and at that moment broke into the attic, subdued Kyung-hyeon and brutally murdered him.

As a result of the autopsy, the estimated time of death was shortly after the last phone call with her mother, Hye-eun. The autopsy doctor said, "It is believed that he was killed immediately after eating because the contents of the stomach were full in the stomach in an undigested state." And he noticed a singularity found on the body. Kyunghyeon, who was stronger than Baek Kwang-seok, said no noticeable strap marks or defense marks were observed on his body. It is presumed that there were several external forces such as some kind of beating or hitting the floor,” he added.

Kyunghyeon's head was damaged by at least 10 strong impacts, and there was considerable bleeding in the scalp. If we estimate the order of the crime from the wounds left on the body, it is believed that the first time, several assaults were concentrated on the face and head, then the hands and feet were tied while losing consciousness, and then there was strangulation using the hands and belt, and then he died. seemed In addition, the killers showed the brutality of covering up Kyunghyeon's nose and mouth with tape.

Baek Kwang-seok commits a brutal crime with an accomplice. In response, her mother, Hye-eun, told her that she wanted to go back to before she met him. Hye-eun, whom she met by chance with her middle school classmate Baek Kwang-seok five years ago, and the two people who were in a similar situation, gradually became closer.

However, at some point, Baek Kwang-seok's obsession grew, which led to frequent fights and revealed his violence. And as they prepared to open a restaurant in May, the couple's conflict reached a climax. Baek Kwang-seok hit Hye-eun's head with a cup. From that moment on, journeys that crossed the line of Baek Gwang-seok began. He threw away or destroyed Hye-eun's belongings, which led to assault each time. Kyunghyeon-gun strongly opposed his stepfather Baek Kwang-seok, and Baek Kwang-seok's assault was directed at Kyunghyeon-gun.

Nevertheless, Hye-eun couldn't break up with Baek Kwang-seok because of the threats he used to make. Baek Gwang-seok pressured Hye-eun, saying, "Kyung-hyeon, whom you love the most, will kill and die." After the big fight, Baek Kwang-seok left the house, but came back to use violence. Baek Gwang-seok sneaks into the house and strangles Hye-eun, who was sleeping.

In the end, the mother and child even requested protection from the police in early July. After some time, as a result of the police action, CCTV was installed in Hye-eun's house. And even in this situation, it was revealed that Kyung-hyeon comforted and reassured her mother, adding to the sadness.

Baek Kwang-seok admits to most of the charges after the arrest, but denies intentionality and insists that it was an accidental murder. However, when he traced his actions on the day of the incident, his crimes did not appear to have been accidental.

Baek Kwang-seok and Kim Si-nam have been preparing for the crime since early in the morning. And the transfer of 7 million won from Baek Kwang-seok's account to Kim Si-nam's account seemed like a reward.

Baek Gwang-seok stayed at home for about 3 hours after the crime and left. During that time, he broke Kyunghyeon's cell phone and sprayed cooking oil all over the house. Why did you do this?

The police explained, "He said he wanted to die inside. He was trying to commit suicide, but he is saying that he changed his mind and came out in the process of talking to people around him." He also claimed that he tried to commit suicide at the motel he had escaped from after the crime, but was unable to do it because he was arrested. And after he was arrested, he attempted to self-harm in a prison cell.

Regarding his behavior, an expert said, "If he was going to commit suicide, he had enough time." "It is very likely that he would have killed his mother and set fire to it."

And in a conversation with his brother after a big fight with Hye-eun, Baek Kwang-seok did not admit his fault and continued to emphasize that he was an unfair victim. The expert said, "If you think like this, that I am a victim, you are taking revenge because of the victim's consciousness." "In this case, my self-esteem was hurt because of my son. analyzed.

The crew met Baek Kwang-seok's family during the interview. His father revealed that Baek Kwang-seok frequently caused financial problems, large and small, and assaulted a woman he had lived with in the past. In fact, it was revealed that he had already been convicted of 10 criminals, including being punished for retaliatory crimes for harassing ex-lovers. And Baek Kwang-seok mercilessly killed Hye-eun's son, who was unaware of this fact, five years after he was released from prison.

An expert said, "What if a more detailed review of Baek Kwang-seok's criminal history had been made when revealing his identity or operating a personal protection program?" In response, a Jeju police official said, "When a case is submitted, we basically check all criminal records. Baek Gwang-seok also checked his criminal record." They acknowledged what they had missed.

Hye-eun, who reported Baek Kwang-seok to the police 16 days before the incident, and 15 days before the incident, someone cut off the gas valve hose, so Hye-eun asked the police for personal protection. In response, the police took emergency temporary measures for Hye-eun, and ordered Baek Kwang-seok to stop access. However, it turned out that Baek Kwang-seok did not receive a call from the police for a restraining order.

In particular, the personal protection program was activated and the smart watch payment was decided, but due to the mistake of the person in charge, it was not delivered to the mother in time, which led to a murder case. Hye-eun said, "They said they had a smart watch on the 6th. If they had given it to them, this wouldn't have happened." "I brought it with me on the 19th and I'm sorry, and they said that they gave it too late. What would you do if you gave it to me after the child died?" .

CCTV cameras were installed in front of and behind Hye-eun's house, but it was not enough to prevent crime with a camera that only recorded without real-time monitoring of the police situation room. As part of the request for personal protection, patrols were conducted 32 times, but Baek Kwang-seok freely walked around the house, avoiding the eyes of the police.

And Hye-eun said that she informed the police of Baek Kwang-seok's residence, and said, "I made several reports and knew that Baek had a 10 criminal conviction.

So, what can be done to prevent such domestic violence crimes? Mi-so Kim, a victim of domestic violence, said that even when she applied for an eviction order from her husband, the police did not even separate the victim from the perpetrator. He also asked if he would report in front of the perpetrator and said, "How do you say you will report in front of him? Reporting itself is scary."

He also said that he felt like he had been pushed into a corner without any protection because of the police's attitude to asking whether there was an agreement before even knowing the details of the incident.

An expert said, "There are very few countries where the victim does not want punishment. In other countries, the victim does not decide. In the United States, the prosecutor decides." When the victim says, 'I will do something that never happened. I will reconcile and do my best,' such a crime would not happen at all. And in this case, the perpetrator threatens the victim."

In response, Professor Lee Su-jeong said, "If there is objective evidence, either conditional application or if there is objective evidence, the police will have to either make sure that the crime of anti-indictment is not applied despite the victim's will or the law will be amended to move the police."

An expert on this case said, "What is lacking in this case is that the smart watch was not paid on time, but the fact that the perpetrators were not actively secured, and that unless the focus is on sanctioning the perpetrators, it is almost a fiction that we want the domestic violence case to be resolved. ."This case cannot be resolved by completely hiding the victim," he said, emphasizing that the law should be revised in the direction of sanctioning the perpetrator.

He added, "There was a history of violence by the perpetrators in this case that was predictable and preventable. Also, the victim specifically stated the dangerous situation in detail." He added, "We should introduce a mandatory arrest system."

And the prosecution, which has the right to claim interim measures to detain the perpetrator, takes a considerable amount of time to file a claim and get to the courthouse, leaving a gap in victim protection during that period. In Germany, they can be arrested and detained, and in Germany, even the keys to the house can be confiscated."
