A rejection of the appeals which is worth validation.

The Council of State on Monday rejected requests for cancellation of the extension of the health pass to places of culture and leisure accommodating at least 50 people, considering that the epidemic resumption justified such measures.

The Council had been approached by several organizations representing entertainment and leisure professionals.

They demanded the cancellation of the decree of July 19 which requires that an anti-Covid health pass (proving complete vaccination, a recent negative test or immunization) be presented in places such as theaters, games, sport or museums, welcoming at least 50 people, against 1,000 previously.

While the Constitutional Council announced its decision on August 5 on the health pass, the summary judge of the Council of State therefore rejected these appeals.

He notes that the Prime Minister has the power to enact measures applicable to the entire territory in the event of exceptional circumstances such as an epidemic, in particular pending the adoption of a new law.

"The resumption of the epidemic linked to the spread of the delta variant was such as to justify an expansion of the use of the health pass", indicates the judge, underlining a deterioration of the health situation in July and a risk of deterioration "again of greatest concern ”in August.
