In the opinion of industry experts, this provides an important guarantee for the comprehensive protection of children’s ride safety, but at the same time, local regulations should be revised and improved so that the law can be effectively implemented.

  On the eve of Children’s Day, the Beijing Youth Legal Aid and Research Center held an online seminar on “The Rule of Law and Co-governance of Children's Car Safety”. The current situation of the use of child safety seats in China became the focus of attention of participating experts.

  Studies have shown that the correct use of child safety seats can greatly reduce infant mortality in traffic accidents, but the usage rate of child safety seats in China is not ideal.

  "We have done research in more than a dozen large cities in the past few years, and the situation is not optimistic. In some cities, the safety seat ratio is less than 20%." Zhou Wen, Director of the Motor Vehicle Research Office of the Road Traffic Safety Research Center of the Ministry of Public Security Hui revealed such data at the seminar.

  Zhou Wenhui said that the utilization rate of child safety seats in many developed countries is very high, but the current utilization rate of child safety seats in my country has a lot of room for improvement.

This is related to parents' awareness, legal constraints, publicity and education, and inconvenience in product use.

  According to the "China Children's Traffic Safety Blue Book 2018" issued by the China Automotive Technology Research Center earlier, the most important way for children to travel by car is to have their parents holding their children in the back seat, accounting for 55.23%.

But in the eyes of experts, such an approach hides huge risks.

  Xu Zhe, chief inspector of child seats at the China Automotive Technology Research Center Co., Ltd., said that at the moment of a collision, a 10 kg child will produce 300-500 kg of force, which is difficult for parents to hold.

Even if by chance, the parents do not completely fly out, the parents will physically oppress the child due to inertia, causing the child to hit the front seat and suffer serious injury.

  The newly revised "Minor Protection Law" clearly stipulates that guardians should "take measures such as equipping child safety seats and educating minors to abide by traffic rules to prevent minors from being injured by traffic accidents."

  However, in the opinion of experts, despite the existence of national legislation, there is currently no more detailed regulation on the mandatory use of child safety seats and child safety systems in the "Minors Protection Law".

  Tong Lihua, director of the Beijing Youth Legal Aid and Research Center, said that unprotected laws, road traffic laws, local unprotected regulations and road traffic regulations are a legal system.

The necessity and legitimacy of such a rule is established in the non-guaranteed law. The future revision of the road traffic safety law, including the amendments to the local non-guaranteed regulations and local road traffic regulations, should write the issues more carefully and more operably .

  Wang Yang, Director of the Industrial, Youth and Women’s Office of the Social Construction Committee of the National People’s Congress, emphasized that the "Road Traffic Safety Law (Revised Draft)" promulgated by the Ministry of Public Security in March of this year added the content of children’s car safety. And mandatory use of child safety seats and other restraint systems to make more specific regulations and stipulate corresponding penalties.

  For example, the height standard of 140 cm is adopted for the objects who should ride in the safety seat, which is more scientific and easier to operate than the age standard of the previous local legislation.

If it can be passed, it will promote the implementation of the safety protection system for minors.

  Wang Yang said that in the process of promoting the revision and improvement of local regulations, he hopes that it will be consistent with the higher law and be innovated in accordance with the actual conditions of the localities.
