  Article 44 of the Labor Law of the People’s Republic of China stipulates that in any of the following circumstances, the employer shall pay wages higher than the wages of workers’ normal working hours in accordance with the following standards: Wage remuneration less than 150% of the salary; if the worker is arranged to work on a rest day and cannot be arranged for compensatory time, pay no less than 200% of the salary remuneration; if the worker is arranged to work on a legal holiday, the pay is no less than the salary 300% salary remuneration.

  In other words, if you choose to work overtime on May 1st, you will get three times the overtime pay; if you work overtime from May 2 to 5, you will get twice the overtime pay.

It is worth noting that regardless of whether the overtime wage is 3 times or 2 times, the employer pays the employee after paying the monthly wages.

Therefore, based on the calculation of "triple daily wages on May 1st and twice daily wages for the next 4 days", the wages for five days of overtime work during the May 1st holiday is equivalent to the income from 11 days of work.

  For example, if the monthly salary standard of a company employee Xiao Wang is 6000 yuan, according to the Ministry of Human Resources and Social Security, the monthly salary is 21.75 days, so Xiao Wang's daily salary is 275.86 yuan.

Xiao Wang works overtime on May 1 and can get overtime pay of 827.58 yuan; if Xiao Wang works all overtime for 5 days, he will receive overtime pay of 3034.48 yuan, which is equivalent to the usual 11 days of daily wages.
