  As the first departmental regulation in the field of online recruitment services in my country, the "Regulations" provide for the access, service specifications, supervision and management, and legal responsibilities of online recruitment service activities.

Among them, all kinds of chaos in online recruitment, such as job-seekers’ resumes being sold, personal information being leaked, prepaid deposits, and false recruitment, can be found in the "Regulations".

  Many industry experts pointed out that the "Regulations" fills the regulatory gap for online recruitment service agencies, and platforms engaged in online recruitment should strictly follow the "Regulations" and other relevant laws and regulations, rectify and correct their own problems as soon as possible, and operate in compliance with laws and regulations. , Purify the employment environment, and maintain the order of the human resources market.

Job resumes flow into the black market

  Internet recruitment platforms such as Zhaopin recruiting were named: user resume information on the platform flowed out and was sold by criminals on the Internet black market, which may have led to multiple fraud cases.

  The outflow is not accidental or accidental. According to a CCTV survey, it is related to the business model of the recruitment platform.

Take Zhaopin Recruitment as an example. Under normal circumstances, enterprise users on Zhaopin Recruitment can only view information such as the applicant's academic qualifications and work experience, while key information such as name, phone number, and email address are hidden.

  If users want to download a job applicant's resume, they can buy it with money.

According to Zhilian Recruitment's customer consultant, according to the level of qualifications of the job applicant, the price of the resume is clearly marked from 40 to 100 yuan per copy.

  In the final analysis, as long as you successfully register a corporate account (the corporate account qualification may be forged) and are willing to pay, downloading job applicants' resumes in large quantities can be achieved.

In addition, if enterprise users have registered for platform membership, they can also download unlimited numbers.

  So, where will these downloaded resumes of job applicants go?

In addition to formal channels, criminals also flowed a large number of resumes into the online black market. When these personal information including name, gender, age, photo, contact information, work experience, education experience and other personal information entered the online black market, they were used for fraud and other illegal activities. The way, finally leads to tragedy can be imagined.

  In this process, the job seeker is completely unaware.

Because, when the user resume is downloaded by the corporate account, the personal client will not receive the corresponding prompt.

Zhilian Recruitment customer consultant said that after the user's resume is created, it will be made public by default.

  As for corporate users, Zhaolian Recruitment does not have effective restraint measures, but in its external statement, Zhaolian Recruitment stated that enterprise users should not disclose the resume information of job applicants in any way.

  In addition to Zhaopin Recruitment, Internet recruitment platforms such as 51job.com and Liepin.com all have similar situations. Downloading job applicants' resumes into a business is the crux of the problem.

However, corporate users can only see the resume information delivered for their posts (in this case, the user agrees to disclose the information to the employer).

However, as long as you are willing to spend money, you can download resumes without restrictions, which is a manifestation that the platform has not fulfilled its information security obligations.

Online recruitment is chaotic

  The "Li Wenxing case" that has caused a sensation is one of them.

College student Li Wenxing was caught in a Tianjin MLM scam after applying for a job on the "BOSS Direct Employment" platform, and eventually died after losing contact.

  In a false recruitment scam case on the "58.com" website, a job seeker applied for an advertising company’s fitting and shooting model on the "58.com" website. Before the interview, the advertising company asked the advertising company to apply for a scam with a value of more than 10,000 yuan. Promotional card, and then the shooting can be arranged.

Afterwards, the job applicant found out that he had been deceived, and when he returned to the interview place the next day, the other party was already empty.

  From a distance, it is easy and quick to find high-paying and good positions, but it is possible to "step on the pit" if you really come closer. Job seekers can pay hundreds of yuan, or they can be debt-laden, and even suffer physical and mental torture...

  But this does not mean that online recruitment should be completely denied.

It must be admitted that the popularity of online recruitment is the general trend.

According to statistics, as of the end of 2019, there were 39,600 human resources service agencies nationwide, and 15,000 human resources market websites were established. In 2019, 404 million recruitment information and 823 million job search information were released online.

  According to the "Semi-annual Report on the Development of China's Online Recruitment Industry" released by iResearch, the average monthly coverage of online recruitment websites in the first half of 2020 was over 70 million, reaching its peak in March, and the number of users exceeded 80 million.

In addition, affected by the new crown pneumonia epidemic, "cloud recruitment" has become popular, and video interviews, AI interviews and other forms have emerged.

  The advantages of online recruitment are obvious.

Compared with traditional offline recruitment, online recruitment can greatly improve the efficiency of information connection between employers and job seekers, which is also in line with the development direction of the network society.

It was used extensively during the epidemic.

  But the problem of online recruitment also exists.

Due to the "virtual" nature of the network, the risk will also be significantly amplified if the corresponding qualification checks and industry standards are lacking.

For example, some unqualified or even illegal recruitment units and behaviors may openly obtain "deception" opportunities through online recruitment.

Another example is the leakage of personal information mentioned above, which causes more harm due to faster and more convenient online dissemination.

Severe punishment for illegal acts

  Fortunately, this issue has been paid attention to by the regulatory authorities.

The Ministry of Human Resources and Social Security has issued the "Regulations", which will be implemented on March 1.

  According to the "Regulations", human resource service agencies engaged in online recruitment services shall be responsible for the authenticity of the recruitment brochure, business license, or documents approved by the relevant department, the identity certificate of the personnel responsible for the release of recruitment information, and the authenticity of the employer’s entrusted certificate provided by the employer. , The legality is reviewed.

If the information review obligation is not fulfilled in accordance with the law, the administrative department of human resources and social security shall order correction; if the correction is refused and there is no illegal income, a fine of less than 10,000 yuan shall be imposed; if there is illegal income, the illegal income shall be confiscated and 10,000 yuan shall be imposed. A fine of not less than RMB 30,000 but less than RMB 30,000.

  In terms of personal information protection, the "Regulations" require human resource service agencies to collect and use their users' personal information when engaging in online recruitment services, and they shall abide by laws and administrative regulations on personal information protection.

Human resource service agencies shall establish and improve the user information protection system for online recruitment services, and shall not disclose, tamper with, damage or illegally sell or illegally provide to others the personal citizen ID number, age, gender, address, contact information, and operation of the employer. Status and other information.

The human resources service agency shall conduct self-inspection on the information protection of online recruitment service users at least once a year, record the self-inspection, and promptly eliminate potential safety hazards discovered during the self-inspection.

  Prepayment of deposits is also expressly prohibited.

The "Regulations" require that operating human resource service agencies engaged in online recruitment services shall not collect deposits from workers, and shall clearly indicate their service items, charging standards and other matters.

  According to the "Regulations", special law enforcement actions to clean up and rectify the order of the human resources market will be carried out on a regular basis, work with relevant authorities to implement special rectification of online recruitment services, investigate and deal with various violations of online recruitment services in accordance with the law, and severely crack down on the provision of false recruitment information and illegal collection Expenses, illegal activities such as online recruitment services without permission.

The notice requires that day-to-day supervision be strengthened, and spot checks should be strengthened for those with bad credit records and high risks.

Carry out online market inspections, establish a sound risk pre-judgment and early warning mechanism, and strengthen the risk monitoring and prevention of online recruitment services.

In the event of serious violations of laws and regulations in online recruitment service agencies, they may interview their relevant persons in charge, conduct warning talks, point out problems, and order rectification and correction.

  Intensify the investigation and punishment of illegal acts of online recruitment.

Regularly carry out special law enforcement actions to clean up and rectify the order of the human resources market, implement special rectifications on online recruitment services in conjunction with relevant competent departments, investigate and deal with various violations of online recruitment services in accordance with the law, and severely crack down on providing false recruitment information, charging fees in violation of regulations, and arbitrarily without permission Engage in illegal activities such as online recruitment services.

At the same time, promote the integrity of online recruitment services.
