　　A college teacher in Sichuan was sentenced to 5 years and 10 months in prison for jointly accepting bribes with officials of the Lok Horse Department. The relevant criminal verdict published by China Judgment Documents Network recently disclosed the above information.

　　The Paper (www.thepaper.cn) sorted out the judgment and learned that Xu, the former deputy director of the EMBA Education Center of Sichuan University Business School, was a specific person of Li Lingxiang, the former party committee member and deputy general manager of Sichuan Airport Group Co., Ltd.

In 2016, Xu 1 accepted the request and, with the help of Li Lingxiang, made others successfully bid for the foundation treatment and earthwork works of Chengdu Tianfu International Airport.

Afterwards, the winning bidder gave Li Lingxiang and Xu a total of 9.99 million yuan.

In December 2020, Xu 1 was sentenced in the first instance of the bribery case.

　　Public information shows that Li Lingxiang, male, Han nationality, was born in September 1963 in Yongchuan, Chongqing, with a postgraduate degree on the job. He joined the Communist Party of China in July 1984 and joined the Communist Party of China in December 1995.

　　Li Lingxiang has worked at Chengdu Shuangliu Airport for a long time. In 2004, he served as a member of the Standing Committee of the Party Committee and Deputy General Manager of Sichuan Airport Group Co., Ltd., and concurrently served as deputy commander and chief engineer of Chengdu Shuangliu International Airport's expansion headquarters.

Since 2015, Li Lingxiang has been transferred to the party committee and deputy general manager of Sichuan Airport Group Co., Ltd., and then concurrently served as party secretary and executive deputy commander of Chengdu Tianfu International Airport Construction Command.

　　In April 2020, Li Lingxiang accepted disciplinary review and supervision investigation for suspected serious violations of discipline and law, and was double opened 8 months later.

　　According to the aforementioned judgment, Xu 1 had served as the class teacher of the "EMBA2011 State-owned Enterprise Class of Sichuan University Business School" in September 2011. Li Lingxiang was a student of this class. With the increase in contact, the two gradually developed into a specific relationship.

In 2012, Xu 1 was appointed as the deputy director of the EMBA Education Center of the School of Business of Sichuan University.

Xu 2 (handled in another case) is a student of "Sichuan University Business School EMBA2013 Spring Class".

　　One day in the first half of 2016, when Yang 1 (handled in another case) learned about the upcoming implementation of the foundation treatment and earthwork works of Chengdu Tianfu International Airport, he invited Xu 2 to cooperate in the project.

Yang 1 will tell his brother Yang 2 about the cooperation with Xu 2 and hope that the other party can help.

Yang 2 was also a student of "EMBA2011 State-owned Enterprise Class of Sichuan University Business School". Because he knew the relationship between Xu 1 and Li Lingxiang, I suggested Xu 2 to ask Xu 1 for help.

　　Subsequently, Xu 1 accepted the request and often helped invite Li Lingxiang to have dinner with Yang 2 and Xu 2 and play mahjong. After Xu 1 introduced and Yang 2 recommended, Li Lingxiang agreed to help Xu 2.

Xu 2 promised to give 3% of the contract price after winning the bid, Xu 1 informed Li Lingxiang of the benefit and got the latter’s approval.

　　According to the judgment, during the bidding process of the project, Xu1, through Li Lingxiang and his subordinates, informed Xu of the prequalification registration conditions obtained in advance, the number of experts for prequalification evaluation, the bidding scoring rules, and the division of bid sections of the project. .

Li Lingxiang took advantage of his position to greet his subordinates in the process of pre-qualification, bid division and bid evaluation of the project, and helped the Gansu Mechanized Construction Engineering Co., Ltd. (referred to as Ganji Construction Company), which Xu 2 is affiliated with, successfully won the bid for 457 million yuan Section 04 of Chengdu Tianfu International Airport foundation treatment and earthwork works.

　　During the construction process, Xu 2 gave Xu 1 a total of 9.99 million yuan in six times from May 2017 to early 2019.

Every time Xu received money, he informed Li Lingxiang, and Li asked Xu to keep it.

Xu 1 gave Li Lingxiang 200,000 yuan in two splits for daily expenses.

　　According to the information in the judgment, Xu 1 was detained by the Guangyuan Supervisory Committee in January 2020 on suspicion of duty violations. He was detained in September of the same year and arrested in October of the same year.

　　In November 2020, the People's Procuratorate of Jiange County, Sichuan Province filed a public prosecution on Xu's case of bribery.

　　The Jiange County People’s Court pointed out that Xu 1 was a specific person related to Li Lingxiang, the former party secretary and executive deputy commander of the Tianfu International Airport Construction Headquarters. Together with Li Lingxiang, he took advantage of Li Lingxiang’s position to seek benefits for others and illegally accept other people’s properties. The total amount is RMB 9.99 million, which is extremely large. His behavior has constituted the crime of accepting bribes and should be punished in accordance with the law.

　　At the same time, in the joint crime, Li Lingxiang took advantage of his position to disclose relevant information to Xu 1 before bidding, and instructed Xu 1 to obtain bidding-related information from his subordinates to Xu 2 and greet his subordinates to make Gan Jijian Company won the bid.

Li Lingxiang’s help was decisive for Ganjijian’s bid, and he played a major role in the joint crime and was the principal offender.

As a specific person of Li Lingxiang, Xu1's behavior of accepting property depends on Li's identity and powers, and plays a secondary role in the joint bribery crime. He is an accomplice and should be given a lighter, mitigated punishment or exempted from punishment in accordance with the law.

　　In December 2020, the court made a first-instance verdict, Xu 1 guilty of accepting bribes, sentenced to 5 years and 10 months in prison and fined RMB 600,000.

The stolen money returned by the Guangyuan City Supervisory Committee was 5,55699.18 yuan, and the stolen money returned during the trial period was 4,530,300.82 yuan, which was confiscated according to law and turned over to the state treasury.
