The installation of cameras in Haidilao’s private rooms has been questioned.

Netizens dispute whether it is “invasion of privacy.” Haidilao said it recorded the situation

On February 27, the news that "Haidilao installed cameras in private rooms" was hotly discussed by netizens.

Netizens hold their own opinions on whether installing a camera will violate privacy.

Haidilao’s customer service said that the private room is a restaurant and part of a public place, and the camera is installed to record the situation.

Install the camera in the private room

Earlier news said that cameras were installed in private rooms of Haidilao's multiple stores.

A reporter from Beijing Youth Daily visited many Haidilao stores in Chaoyang District, and indeed saw cloud-based cameras in the private rooms.

Subsequently, the reporter visited some other brand catering companies and found that the phenomenon of installing cameras in hotel rooms is not uncommon.

Of the 8 restaurants visited, 3 private rooms have cameras.

However, there are no related prompts such as "monitoring inside" in some private rooms.

Stores that have installed cameras also said that the installation is mainly to prevent customers from losing things and to facilitate retrieval.

Regarding the installation of cameras in private rooms, Haidilao has previously replied to the media that: To ensure the safety of consumers’ meals, each store will install monitoring equipment, including private rooms, in accordance with the characteristics of the stores; at the same time, Haidilao pays attention to protecting customer privacy and the company has established monitoring management Relevant systems and procedures, and at the same time strengthen management and control through technical means to protect consumer rights.

However, when a reporter from Beijing Youth Daily further interviewed him on the necessity of installing cameras, Haidilao did not respond temporarily as of press time.

Is the private room a privacy space?

  Can it be installed?

There was a camera in the private room which caused heated discussions among netizens.

Some consumers think that this will leak consumer privacy. After all, they choose a private room to have a private space, but there are cameras that will feel like they are being monitored.

Netizens who think they are acceptable said that no matter how private the restaurant is, it is also a public place. As long as the camera is bright, there is nothing unacceptable.

The focus of the dispute among netizens in this incident is whether the private room is a "public place". Haidilao's customer service previously stated that the private room is a restaurant and part of a public place, and the camera is installed for recording.

However, some lawyers believe that the private room is different from the lobby. It is a closed space and also a relatively private space. Consumers’ words and deeds in the private room are private activities and are usually unwilling to be known to others, so they belong to the scope of privacy.

A reporter from Beijing Youth Daily learned that there are no clear laws and regulations governing whether cameras can be installed in private rooms.

Among the regulations concerning “cameras” in the catering industry, the “Regulations on the Public Security and Security of Catering Enterprises in Beijing” clarify that large and medium-sized catering companies shall, in accordance with the relevant laws and regulations, use the Set up image information collection points at the entrances and exits of underground parking lots, cash registers, accounting rooms, passenger elevators, escalator entrances, etc., and set significant reminders.

The image information system shall operate normally during the business period without interruption.

In this regulation, private rooms are not listed.

However, with the emergence of some consumer disputes in recent years, the installation of cameras has become a means of "self-protection" for businesses.

Previous investigations stated that among the 30 hot pot restaurants, 19 had cameras installed in their private rooms; among the 14 non-hot pot restaurants, two had cameras installed in their private rooms.

Some people in the industry said that some unscrupulous customers "touched porcelain" the catering industry, and the hot pot industry was the hardest hit.

As early as 2018, a consumer claimed to have eaten sanitary napkins at a Haidilao in Shenzhen. Finally, the police intervened and the consumer claimed to have put it in.

In November of the same year, Guo put the pre-prepared mice into the Haidilao hot pot, and later demanded RMB 5 million for food safety reasons. Later, Guo was found guilty of extortion.

However, even if businesses install cameras in their private rooms for various reasons, they are not able to "snoop" consumers at will.

A reporter from the Beijing Youth Daily learned that the "Administrative Measures for the Beijing Municipal Public Security Image Information System" implemented in 2007 stipulated that the establishment of a public security image information system must not infringe on citizens' personal privacy; image information involving citizens' personal privacy should be kept confidential Measures.

In addition, for unauthorized access to, copying, providing, and dissemination of image information, the public security organs shall impose a fine of 10,000 yuan to 30,000 yuan on the unit, and the main person in charge and the person directly responsible for the unit shall impose a fine of 500 yuan to 1,000 yuan. Fines; those that constitute a violation of public security management shall be punished by the public security organs in accordance with law; those that constitute a crime shall be investigated for criminal responsibility in accordance with the law.
