When the bus drove to the textile market, a drunk man got on the bus and sat in the first row.
After driving for a few stops, the man suddenly said that the vehicle was in the wrong direction and asked to stop.
The driver ignored him, and the man started clamoring.
When the vehicle arrived at Wuning Road Zhenbei Road Station, the driver stopped and opened both doors, allowing the man to get out of the car and take the opposite side.
However, the man not only refused to get out of the car, but also spoke badly.
The passengers sitting in the back of the car couldn't see it, and together advised him to get off.
The irritated man became more frantic, arguing with the persuading passenger, and punched one of the male passengers in the face. The victim immediately had a nosebleed.
The driver called the police when he saw it, and the police arrived at the scene to take both parties involved to the police station.
After investigation, the name of the beating man was Ding XX. That night, he and his colleagues drank 8 taels of liquor and a few bottles of beer at a restaurant in Fengzhuang, Jiading.
"I know myself better, and I will swear when I get excited. I went back home and recalled it carefully. I had beaten this man." Ding said.
The prosecutor believes that the defendant Ding XX took the wrong bus for his own reasons after drunk, and after asking the driver to stop, he beat and scolded the persuading person on the bus at will, and caused a minor injury to one person. This is a typical drunk disturbance behavior.
What Ding Moumou violated was not only the personal rights of the victim, but also the arbitrary beating of persuaded passengers, which was a serious damage to the social order, and his behavior was more in line with the constitutional requirements of the crime of provoking trouble.
Because Ding had a better attitude of pleading guilty and repentance after arriving in the case, actively compensated the victims for economic losses, and obtained understanding, the Putuo District Procuratorate filed a public prosecution with Ding XX for the crime of provoking quarrels and provoking disturbances on December 23, 2020. It is recommended to apply the expedited procedure. Later, the Putuo District Court sentenced Ding XX to seven months’ imprisonment and one year’s probation for the crime of provoking disturbances.
