On the 23rd of this month, Li Zhiying applied for bail to the High Court for approval of the two merger cases.

On the 31st, the Department of Justice applied to the Court of Final Appeal for permission to appeal, and applied for a provisional order to detain Li Zhiying again while waiting for permission to appeal, which was approved by the Court of Final Appeal.

Li Zhiying must be remanded in custody awaiting trial, and the next court appearance will be February 1.

  The prosecution pointed out that the defendant faced serious crimes under the Hong Kong National Security Law, which could be sentenced to life imprisonment. Like murder suspects, courts generally will not grant bail.

Article 42 of the Hong Kong National Security Law states that unless the judge has sufficient reason to believe that the defendant will not continue to commit acts endangering national security, he shall not be granted bail.

This means that in terms of bail, the judge should focus on whether the defendant is at risk of absconding or re-offending, rather than using bail conditions to reduce the defendant’s risk of absconding or re-offending.
