  • Journalist Rokhaya Diallo, targeted by racist remarks by a listener, attacks the listener in question.

But why not the radio itself?

  • From a legal point of view, the journalist could have attacked the station, explains a lawyer specializing in media law, Zoé Vilain.

  • "I do not derive pleasure from initiating lawsuits so I accept the apologies and hope that such comments will in the future be the subject of a firm and immediate condemnation", reacts the journalist to

    20 Minutes.

"Because Mrs. Diallo, she would not have benefited from everything France gives, I think there is a good chance that she would be in Africa, with 30 kilos more, 15 kids crushing the mil on the ground and wait for her husband to give her his turn between the 4 other wives ”.

In one sentence, a Sud Radio listener put end to end in the program

Les Vraies Voix

the worst clichés about Africa, reducing a continent to poverty and polygamy.

The journalist Rokhaya Diallo, targeted by his remarks, replied two months later by suing the listener in question.

But why, in fact, not to have attacked the radio itself?

From a legal point of view, the journalist could very well have attacked the station.

"The media are considered as publishers and are responsible for their publications," explains Zoé Vilain, lawyer specializing in intellectual property and media law.

At the very least, it would have been necessary to moderate the remarks, explains the lawyer.

What has not been frankly done: "Attention (LFI MP) Danièle Obono will fall on you", on the contrary joked the magistrate Philippe Bilger.

"Suffice it to say, as you said, that Rokhaya Diallo was lucky to be in France and to have real freedom of expression," timidly tempted presenter Philippe Rossi for his part.

Rare excuses

If Rokhaya Diallo did not want to attack the radio, it is rather because the latter offered an apology, which seems rare to the journalist regularly victim of racist remarks: “The CSA was seized and the radio presented apologies and pledged to be more vigilant.

It is a pity that it took two months to elapse and the emergence of a controversy for this reaction to occur, but it did take place, which is rare.

I do not derive pleasure from initiating lawsuits so I accept the apologies and hope that such remarks will in the future be the subject of a firm and immediate condemnation, ”reacts the journalist to

20 Minutes

.

Finally, if you are wondering whether the journalist could have attacked Twitter, Facebook or any other social network in the event of comments made on these platforms, the answer is different, explains Maître Vilain: “Unlike the media, hosting platforms only have a posteriori responsibility, from the moment they have been notified of the content ”.

And if you have any other questions, feel free to ask
