This case is the first unqualified crime of recycling waste batteries to pollute the environment in Shaanxi Province.

  The People’s Procuratorate of Xi’an City alleges: From October 2016 to March 2018, the defendant Li and Jia (deceased) opened a waste battery in a place in Luoning County, Henan Province without obtaining a hazardous waste business license. Dismantling the smelter, dismantling used lead-acid batteries to extract lead ingots and sell them for profit.

Later, Li was introduced and contacted the defendants Guo, Chen and others in Xi'an, and purchased waste lead-acid batteries from Guo, Chen and others, and transported the purchased lead-acid batteries to the smelter. , Disassemble the used lead-acid batteries, take out the lead cores from the batteries and smelt them into lead ingots, and sell the lead ingots to a company in Jiyuan City, Henan Province for profit.

  In the process of dismantling the used lead-acid batteries, Li did not do any harmless treatment of the toxic acid discharged from the dismantling of the used batteries, but was directly discharged into the local soil, causing serious pollution to the environment.

In order to earn more profits, Guo knew that Li opened a "black workshop" for illegally disposing of used batteries, and still sold most of his collected lead-acid batteries to Li, with a sales amount of more than 19.33 million yuan.

  Defendant Chen, knowing that Defendant Li did not have a hazardous waste business license, sold a large number of waste batteries acquired to Li's lead smelting workshop for illegal dismantling and extraction of lead blocks.

From September 2016 to November 2017, the defendant Chen received a transfer from Li to sell used batteries for more than 12.05 million yuan.

  During the trial, the defendants Li, Guo, Chen and their respective defenders had no objection to the basic facts and charges of the crime of illegal business operations accused by the indictment, and defended the amount of crime and the degree of environmental pollution caused by the crime.

The public prosecution agency presented relevant documentary evidence, appraisal report, identification transcript, witness testimony, and defendant's confession in court against the facts of the charges.

The court organized the prosecution and the defense to conduct cross-examination and debate on the focus of the dispute.

After the court debate, the defendants Li, Guo, and Chen made their final statements to the court.
