Huanghe Institute of Science and Technology: Can apply for restoration of their student status

  "As long as I can go to school, I am willing to do anything. It doesn't matter what I have suffered in the past two years." Recently, Wang Qi from Henan reported to The Paper (www.thepaper.cn) that she was caught by Henan two years ago. Enrolled in the Huanghe Institute of Science and Technology, a private university in the province.

However, without his knowledge, he missed the freshman registration and lost the opportunity to study.

For two years, she has been negotiating with the school, hoping that the school can restore her student status and finish her studies as soon as possible.

  Wang Qi's counselor, Wang Song, told The Paper that after enrolling in 2018, Wang Qi has not taken the initiative to submit relevant materials to complete the student registration procedures. The school failed to urge the school until the deadline for student registration was missed.

  On November 24, Wang Junsheng, director of the Propaganda Department of the Party Committee of the Yellow River Science and Technology Institute, told The Paper that if Wang Qi has the will to continue studying, the school can apply to the higher education administrative department to restore her student status.

  In 2018, Wang Qi was admitted as a law student of Huanghe University of Science and Technology.

Wang Qi told The Paper that she applied for a student loan of 8,000 yuan before enrolling.

After the approval, she gave the loan receipt to the school on the day of registration.

  "On the day of registration, because I couldn't pay the remaining tuition, the college didn't let me go to register." Wang Qi said that although the student did not register, the school still handled her student ID and arranged a dormitory for her.

  In this regard, Wang Song, Wang Qi's counselor, explained that this was an arrangement made by the school to care for students in difficulties.

  Due to family financial difficulties and unable to afford the remaining 9,000 yuan in tuition, Wang Qi asked the college to ask for two months of leave to earn tuition.

  Wang Song said that after the school started, the school had repeatedly notified students to log on to Xuexin to check their registration status, but the school has not received Wang Qi's feedback, and he himself has contacted Wang Qi many times without success.

  However, Wang Qi said that before the deadline for student registration, the counselor and the college had never contacted her about the unregistered student status.

It was not until November 8 when Wang Qi was applying for bursaries that he was told by the counselor that he could not apply for unregistered students, but that time had passed the deadline for student registration.

  "The leaders and teachers of the college have always felt that I can afford the tuition, but our family does have difficulties." Wang Qi believes that the school did not register for herself because it was unable to pay the tuition on schedule.

  But the school did not approve of Wang Qi's statement.

Wang Junsheng, director of the Propaganda Department of the Party Committee of the Yellow River Institute of Science and Technology, told The Paper that if students cannot afford to pay their tuition fees, they can apply for deferred payment.

"A school is so big that every year, some students propose to postpone the payment of tuition due to financial reasons, and we approved it after verification."

Multiple rights protections failed

  Wang Qi told The Paper that after learning that she had missed the registration time, she had negotiated with the school many times, hoping to re-register for the school, but the school refused.

  After she missed the registration time, the college sent three teachers to her home.

  "With the help of the village committee, the three teachers of the college met Wang Qi's parents and conducted in-depth communication on the relevant situation. The parents expressed their understanding and signed the notice of student status." The written statement to The Paper stated that the move was a last resort for not contacting Wang Qi and his guardian.

  However, Wang Qi believes that it was her aunt who signed at that time, not her guardian, and it had no legal effect.

"It's asking my aunt to sign the materials for my withdrawal. I can only withdraw from school without registering."

  In order to discuss an argument for herself, Wang Qi sued the Yellow River Institute of Science and Technology in court three times last year.

  On the China Judgment Documents website, The Paper also found three judicial documents related to the incident.

On January 4, 2019, Wang Qi sued the school in the form of administrative litigation for the first time. The People’s Court of Zhongyuan District of Zhengzhou City held that Huanghe Institute of Technology is a private non-enterprise unit, neither an administrative agency nor an institution of higher learning. The defendant in the administrative litigation was unqualified, and the court rejected Wang Qi's suit.

  After the administrative litigation failed, Wang Qi filed a civil lawsuit. The People's Court of Erqi District, Zhengzhou City rejected Wang Qi's lawsuit on July 17, 2019.

The court wrote in the ruling that in this case, the defendant was a private university approved by the education administrative department and was qualified to issue a general higher education undergraduate or junior college degree certificate.

In accordance with relevant laws and regulations, colleges and universities have the power to manage, reward or punish the educated, and the school status management is a special administrative management that the school implements on the educated in accordance with the law.

The plaintiff's request for the defendant to register his student status was not within the scope of civil cases.

  Wang Qi refused to accept the ruling and appealed to the Zhengzhou Intermediate People’s Court. The Zhengzhou Intermediate People’s Court also stated that the management of student status is a special administrative management carried out by the school to the educated in accordance with the law and does not fall within the scope of civil cases. Wang Qi's appeal was rejected.

  Wang Qi told The Paper that she is a native of Wenxian County, Henan Province. She came from a single-parent family and had always worked by herself to raise tuition fees.

Since dropping out of school for two years, I have worked as an Internet cafe network manager, SF porter and other jobs, all of which rely on odd jobs to make ends meet.

But she has never given up on fighting for her student status.

"I just want to have a bachelor degree. People in the village laughed at me when I was old. I went to school and what I could do after I read it. If I don't have any money at home, I will earn it myself.

  Wang Junsheng, director of the Propaganda Department of the Party Committee of the Yellow River Institute of Science and Technology, told The Paper that after Wang Qi’s incident, the school had communicated with him many times, but Wang Qi never cooperated. The school hoped to sit down and talk with her.

"Because of overdue registration, Wang Qi's school status has been cancelled. The principal and secretary and I have also reported that if she is willing to continue studying, the school can submit an application to the Provincial Department of Education and try to create conditions for her to complete her studies."

  The Paper Journalist also conveyed the school's opinions to Wang Qi, and she expressed her willingness to try to communicate.

"As long as I resume my school status, I am willing to actively cooperate with school work. Although my life is really under pressure now, I always have hope and don't want to give up."
