  Prior to this, in order to strengthen the supervision and management of drug online sales and regulate drug online sales, the former Food and Drug Administration researched and drafted the "Measures for the Supervision and Administration of Drug Online Sales (Draft for Comment)."

According to the newly revised "Drug Administration Law", the State Food and Drug Administration revised the "Measures for the Supervision and Administration of Drug Online Sales (Draft for Solicitation of Comments)" and again publicly solicited opinions on the measures.

  In the draft published this time, many contents of drug online sales management are clarified.

  For example, regarding the scope of online sales, the draft for comments proposes that online sales of pharmaceuticals shall not exceed the scope of business operations and pharmaceutical business.

If a drug network seller is the holder, he can only sell drugs with the approval number.

Those who have not obtained the qualification for drug retailing shall not sell drugs to individuals.

  Vaccines, blood products, narcotic drugs, psychotropic drugs, toxic drugs for medical use, radioactive drugs, pharmaceutical precursor chemicals, and other drugs subject to special administration by the state shall not be sold online.

  In addition, the draft also emphasizes that drug retail companies selling drugs through the Internet must not give prescription drugs and Class A non-prescription drugs to the public in the form of buying drugs as gifts, and buying commodities as gifts.

  Regarding the issues related to online prescription drugs that have received much attention before, the consultation draft proposes that when pharmaceutical retail companies sell prescription drugs online, they should ensure that the source of electronic prescriptions is true and reliable, and conduct prescription dispensing reviews in accordance with relevant requirements. The prescription is electronically marked.

  In addition, drug online sellers shall comply with the relevant requirements of the national drug supervision and management and online transaction management laws, regulations and rules, and perform related obligations.

When selling drugs to individuals, an online pharmacy service system should be established, with licensed pharmacists to guide rational use of drugs; the number of licensed pharmacists should be commensurate with the business scale; the sales records of the smallest drug sales unit should be clearly retained and traceable.
